Common use of Fact Witness Clause in Contracts

Fact Witness. When an off-duty employee is required to appear before any hearing board, arbitrator, or internal investigation as a fact witness (as opposed to a character witness) as the result of receiving a subpoena or direct order in the course and scope of employment, the employee will be compensated at the same rate as for duty- related court appearances, as set out in Article 24.1 (c). A “fact” witness is one who testifies to what was seen, heard, or observed regarding an underlying event at issue. A “fact” witness is not a witness who testifies to opinions, character, or like testimony.
