HOURS OF WORK AND OVERTIME PAYMENT. 4.1 All employees who work in excess of four (4) continuous hours in the work day shall be granted a relief period during their work day, as work conditions permit.
4.2 When an employee is required or requested to perform functions before or after the regular work day, this time may be used as compensatory straight time if less than 40 hours in a work week and granted by the appropriate administrator. Pre-authorized work performed by employees in excess of forty (40) hours in a work week shall be compensated at a rate of one and one-half or compensatory time at one and one-half hours. This choice is at the option of the employee. Use of such time will be approved by the appropriate administrator with a result of minimum disruption of the educational program. In approving requested use of compensatory time, no request will be unjustifiably denied. Compensatory time must be taken in the current school year in which it was granted. At the end of the school year compensatory time accrued will be paid.
4.3 Overtime compensation and compensatory time is time actually worked. This means that days not actually worked such as unpaid holidays and other unpaid leaves of absence will not count toward the hours per week to qualify for overtime pay or compensatory time.
4.4 Overtime work will be distributed equally as is practical among those employees who normally perform the work.

13.2 The normal work week will be forty (40) hours in a seven (7) calendar day period.
13.3 Except where otherwise specified herein, overtime will be paid at time and one-half (1 ½) the employee’s regular pay rate for all hours worked in excess of forty (40) hours of actual work in a scheduled work week. Work schedules will not be changed without five (5) working days notice. Bereavement leave and advanced scheduled vacation are considered time worked for overtime calculations provided each were requested and approved in the previous work week. Sick leave will not be considered as time worked for overtime calculations.
13.4 An employee called back to work due to standby status, or an emergency shall earn a minimum of three (3) hours call back pay which is considered time worked for overtime calculations. An employee does not receive three (3) hours call-back pay for each call back in a work day. If an employee is called back more than once (1) in a work day and his total time is less than three (3) hours, the employee will receive a minimum of three (3) hours call back pay. An employee on standby status will receive credit for one (1) hour per day Monday through Friday, and two (2) hours per day for Saturday, Sunday or holiday which counts as time worked for the purpose of computing overtime.
13.5 A City Division requiring workers to be available for emergency work, standby work or overtime work shall initiate and post a format for scheduling workers for duty or availability. If an employee is required to continue work beyond the normal work day then Article 13.3 shall apply. If an employee has been dismissed or released from the work day and is called out to work that same day, then the employee shall be credited with a minimum of three hours of work towards overtime. Only one call out credit can be received during a twenty-four (24) hour period. All work shall be credited towards overtime including up to one-half (½) hour between receiving a call or page and reporting for work. Call out time ends when the employee is dismissed or released by the supervisor at the City work location. HOURS OF WORK AND OVERTIME PAYMENT. 12.1 The provisions of this Article are intended to provide a basis for determining the number of hours of work for which an employee shall be entitled to be paid at overtime rates and shall not be construed as a guarantee to such employee of any specified number of hours of work either per day or per week or as limiting the right of the Authority to fix the number of hours of work (including overtime) either per day or per week for such employee. Departmental management will establish the basic workweek and hours of work best suited to meet the needs of the department and to provide superior service to the community, providing action is not arbitrary nor capricious.

12.3 All authorized and approved work performed by an employee in a classification eligible for overtime, in excess of forty (40) hours in any one work week, shall be paid at the overtime rate of one and one-half (1-1/2) times the employee's straight time hourly rate of pay as set forth herein.
12.4 Only time actually working shall count as hours worked for the purpose of computing overtime.
12.5 Opportunity to work overtime will be distributed as equally as is practicable among employees in the same job classification in the same work section and area, provided the employees are qualified to perform the specific overtime work required. Overtime opportunities will be accumulated on adequate records (which will be available to the Union and employees) and offered overtime not worked will be considered as worked in maintaining these records, provided that nothing herein shall relieve the employee of the obligation to work overtime if required by the Authority, however the Authority will give consideration to an employee's reasons for not accepting an overtime assignment. If any employee establishes that he/she has not received his/her fair share of overtime opportunities, such employee shall have first preference to future weekly overtime work until reasonable balance is recreated.
