Common use of FAILURE OF PAYMENT Clause in Contracts

FAILURE OF PAYMENT. If the Owner does not issue a Certificate for Payment, through no fault of the Design-Builder, within the time required by the Design-Build Documents, then the Design-Builder may, upon seven additional days’ written notice to the Owner, stop the Work until payment of the amount owing has been received. The Contract Time shall be extended appropriately and the Contract Sum shall be increased by the amount of the Design-Builder’s reasonable costs of shut-down, delay and start-up, plus interest as provided for in the Design-Build Documents.

FAILURE OF PAYMENT. If the Owner Manager does not issue a Certificate for Payment, through no fault of the Design-Builder, within the time required by the Design-Build Documents, then the Design-Builder may, upon seven (7) additional days’ written notice to the OwnerManager, stop the Work until payment of the amount owing has been received. The Contract Time shall be extended appropriately and the Contract Sum shall be increased by the amount of the Design-Builder’s reasonable costs of shut-down, delay and start-up, plus interest as provided for in the Design-Build Documents.

FAILURE OF PAYMENT. If the Owner does not issue a Certificate for PaymentPayment regarding undisputed amounts, through no fault of the Design-Design- Builder, within the time required by the Design-Build Documents, then the Design-Builder may, upon seven fourteen (14) additional days’ written notice to the Owner, stop the Work until payment of the amount owing has been received. The Contract Time shall be extended appropriately and the Contract Sum shall be increased by the amount of the Design-Builder’s reasonable costs of shut-down, delay and start-up, plus interest as provided for in the Design-Build Documents.

FAILURE OF PAYMENT. If the Owner does not issue a Certificate for Payment, through no fault of the Design-Builder, within the time required by the Design-Build Documents, then the Design-Builder may, upon seven additional thirty (30)additional days’ written notice to the Owner, stop the Work until payment of the amount owing has been received. The Contract Time shall be extended appropriately and the Contract Sum shall be increased by the amount of the Design-Builder’s reasonable costs of shut-down, delay and start-up, plus interest as provided for in the Design-Build Documents.

The Contract Time shall be extended appropriately and the Contract Sum shall be increased by the amount of the Design-BuilderContractor’s reasonable costs of shut-shut- down, delay and start-up, plus interest as provided for in the Design-Build Contract Documents.

If the Owner does not issue a Certificate for Payment, through no fault of the Design-Builder, Architect, Consultants, or Contractors, within the time required by the Design-Build Documents, then the Design-Builder may, upon seven additional days’ written notice to the Owner, stop the Work until payment of the amount owing has been received. The Contract Time shall be extended appropriately and the Contract Sum Guaranteed Maximum Price shall be increased by the amount of the Design-Builder’s reasonable costs of shut-down, delay and start-up, plus interest as provided for in the Design-Build Documents.
