Common use of Failure of Performance Assurance or Credit Support Document Clause in Contracts

Failure of Performance Assurance or Credit Support Document. If any Credit Support Provider or provider of Performance Assurance of the other Party disaffirms, disclaims, revokes, repudiates or rejects in whole or in part, or challenges the validity of, any Credit Support Document or Performance Assurance provided by it or otherwise fails to comply with or perform its obligations under or in respect of such Credit Support Document or Performance Assurance and such failure is continuing after any applicable grace or cure period.

If any Credit Support Provider or provider of Performance Assurance provider of the other Party disaffirms, disclaims, revokes, repudiates or rejects in whole or in part, or challenges the validity of, any Credit Support Document or Performance Assurance provided by it or otherwise fails to comply with or perform its obligations under or in respect of such Credit Support Document or Performance Assurance Assurance, and such failure is continuing after any applicable grace or cure period.;
