Common use of Failure to Meet Guarantee Clause in Contracts

Failure to Meet Guarantee. For each year of the term of this Agreement, if Accuray achieves a 12-month uptime average of less than 95%, the Agreement period will be extended one (1) week for every percentage point or fraction thereof below 95%.

Failure to Meet Guarantee. For each year of the term of this Agreement, if Accuray achieves a 12-month uptime average of less than 9590-97.9%, the Agreement period will be extended one (1) week for every percentage point or fraction thereof below 9598%.
