Failure to Reach Agreement Mediation. If the parties fail to reach agreement, either party may request the assistance of a mediator to assist in the resolution of outstanding issues. In the event that one party requests assistance, the other party shall join in the request for assistance. The Federal Mediation and Conciliation Service (FMCS) shall be notified and shall provide a mediator. The format, dates, and times of meeting will be arranged by the mediator, and such meetings will be conducted in closed session. The mediator shall meet with the parties or their representatives, or both, forthwith, either jointly or separately, and shall take such other steps as he/she deems appropriate in order to persuade the parties to resolve their differences and effect a mutually acceptable agreement, provided that the mediator shall not, without the consent of both parties, make findings of fact or recommend terms of settlement.
