Common use of Fair and Equitable Treatment Clause in Contracts

Fair and Equitable Treatment. Each Contracting Party undertakes to provide, in its territory and in the maritime area, fair and equitable treatment in accordance with the Principles of International Law to investments of investors of the other party, excluding any unfair or discriminatory measure which could adversely affect in law or in fact the management, maintenance, enjoyment or liquidation of such investments.

Fair and Equitable Treatment. Each Contracting Party undertakes to provide, provide in its territory and in the maritime area, area to investments made by investors of the other contracting party fair and equitable treatment in accordance with generally recognized principles of international law. The Contracting Parties shall consider sympathetically, within the Principles framework of International Law to investments their national legislation, applications for entry and residence permits, labour and movement of investors nationals of either Contracting Party in respect of an investment in the territory or maritime zones of the other contracting party, excluding any unfair or discriminatory measure which could adversely affect in law or in fact the management, maintenance, enjoyment or liquidation of such investments.

The Contracting Parties shall afford sympathetic consideration, within the managementframework of their national legislation, maintenanceapplications for entry and residence permits, enjoyment or liquidation and labour movement presented by nationals of such investmentsone Contracting Party in respect of an investment in the territory of the other contracting party.
