Common use of FEDERAL AND STATE TAX Clause in Contracts

FEDERAL AND STATE TAX. BPS is exempt from federal and state taxes for tangible personal property. Contractor shall not be exempted from paying applicable sales tax to the State of Florida and/or the federal government, as the case may be, for the purchase of materials to fulfill contractual obligations with BPS, nor shall Contractor be authorized to use BPS’s tax exemption number in securing such materials. In the event Contractor is also exempt from federal and state taxes for tangible personal property, it shall promptly submit to BPS an appropriate exemption certificate. BPS will sign an exemption certificate submitted to it by Contractor. Contractor shall be responsible for payment of its own FICA and social security benefits with respect to this Agreement.
