Final Schedule. Each Final Schedule shall be deemed to be the Exhibit or Schedule referred to in this Agreement and shall be part of this Agreement.
Final Schedule. Final Schedule. Once the final schedule is posted, employees seeking additional hours may not use their seniority to override H(1) and H(2), above.
Final Schedule. A final rehearsal and performance schedule will be posted forty-two (42) days in advance of each working day throughout the season.
a) If changes are made between seasons to a final rehearsal and performance schedule, the Musicians will be notified by mail at the home address or another address if so indicated by the Musician.
b) If the week(s) following the forty-second (42) day of the schedule is a holiday week(s) the Centre shall post the date of the first service following the holiday week(s).
c) If a final rehearsal and performance schedule is posted during a scheduled week off, the forty-two (42) days advance notice does not start until the next scheduled work week.
d) In the event of a proposed change in the schedule less than forty-two (42) days in advance, the Musicians will be allowed to vote on the acceptance or rejection of the proposed change. Even if the change is accepted, any Musician who can prove that he has made another commitment based on the original schedule will be excused without penalty from the service in question.
e) If a service is cancelled less than forty-two (42) days in advance, that service will be paid to Musicians, except in the case of a Media Engagement, in which case the appropriate AFM Agreement would apply.
f) In the event that the service is cancelled less than forty-two (42) days in advance, but more than seven (7) days in advance due to circumstances beyond the reasonable control of the Centre, the service will not be applied to Regular Additional Musicians’ contracts, nor will Extra Musicians be paid for that cancelled service.
g) Overtime will be paid for a change in the schedule which is given less than fourteen (14) days in advance from the service in question. Twice per season, the Centre will be permitted to make a change to the schedule with less than fourteen (14) days notice without payment of overtime and no vote will be required to approve the change.
h) In the event that a change in schedule is required because of factors beyond the reasonable control of the Centre, no Orchestra approval will be required and there shall be no obligation to pay the Musicians overtime, but any Musician who can prove that he has made another commitment based on the original schedule will be excused from the service without penalty.
i) A vacation week(s) may be changed following the first day of the season with a vote of acceptance or rejection from the Orchestra. Even if the change is accepted, any Musician who can prove ...
Final Schedule. A final rehearsal and performance schedule will be posted eight (8) weeks in advance throughout the season. If the week(s) following the eighth week of the schedule is a holiday week(s) the Centre shall post the date of the first service following the holiday week(s).
a) i) In the event of a proposed change in the schedule less than eight (8) weeks before the beginning of the week in question, the Musicians will be allowed to vote on the acceptance or rejection of the proposed change. Even if the change is accepted, any member of the Orchestra who can prove that he has made another commitment based on the original schedule will be excused without penalty from the service in question.
Final Schedule. 28 The final schedule containing all lines at the domicile will be posted by 1700 29 hours domicile time on the twenty-fourth (24th) of each month.
Final Schedule. Within thirty (30) days after Purchaser’s completion of all Unfinished Customer Contracts, Purchaser shall deliver to Sellers
(A) the total number of each type of unit delivered by Purchaser under such contract;
(B) with respect to each type of unit, the difference, positive or negative (the “Difference”), between (1) the Sellers’ estimate, to be provided by the Sellers to the Purchaser at the Closing, of the number of such units still required, as of the Closing Date, to complete such Unfinished Customer Contract and (2) the actual number of such units required for Purchaser to complete such contract; and
(C) the aggregate value, positive or negative (the “Adjustment Value”), of all Differences with respect to such Unfinished Customer Contract, which shall be calculated using the applicable unit prices set forth in such Unfinished Customer Contract. Anything to the contrary in this Section 2.02(e)(ii) notwithstanding: (x) any units used by Purchaser in its performance under any Unfinished Customer Contract that were damaged, wasted, lost, used improperly, required replacement or substitution, or were otherwise not necessary for the completion of such Unfinished Customer Contract due to, or in any way related to, any fault of Purchaser or Sellers shall not be included in the calculation set forth in clause (B) of this Section 2.02(e)(ii); (y) no amendments, changes, or revisions to any Unfinished Customer Contract after the Closing shall be taken into account in such to the extent that additional units are required as a result of any such amendment, change, or revision; and (z) any units used by Purchaser due to any fault of Sellers other than Sellers’ estimates will be reimbursed to Purchaser at the unit values provided in Schedule 7.06(b) and will not go against the basket provided in Section 10.04;
