First Plan Year Elections (ACP). For purposes of Section 3.5(A), the ACP for Non-Highly Compensated Employees for the first Plan Year the Plan permits any Participant to make Employee After-Tax and/or Matching Contributions (if this Plan is not a successor plan) (select one): ¨ (1) shall be the Plan Year ACP. ¨ (2) shall be 3%. þ (3) is not applicable.
