Flexibility and Mitigation. If an event or change in circumstance arises during the term of this Contract, the parties shall use their Best Efforts to negotiate in good faith to reach agreement on a solution that will minimize the adverse impacts on cost, performance, schedule or other consequences experienced by either party. If the parties are unable to reach agreement on a solution after submitting the matter for informal dispute resolution process in Section 58 (Disputes), the parties shall nevertheless use their Best Efforts to mitigate the scope of the adverse consequences to the extent practicable under the circumstances. If such mitigation effort results in Changes, the Changes shall be requested/proposed, reviewed, processed, approved and implemented as a Change Order under Section 18 (Change Orders/Requests and Process).
