The Contractor shall allow public access to all documents, papers, letters, or other materials subject to the provisions of Chapter 119, Florida Statutes, made or received by the Contractor in connection with this Purchase Order, except that public records which are made exempt and/or confidential from public records disclosure by law must be protected from disclosure and includes, but is not limited to, criminal history information derived from the U.S. Department of Justice. The Contractor’s failure to allow such public access shall result in the immediate termination of this Purchase Order or any renewal. The Contractor shall maintain public records stored in electronic record keeping systems in accordance with Chapter 119, Florida Statutes, and Rule IB-26.003 of the Florida Administrative Code. (d) Meet all requirements for retaining public records and transfer to the SFWIB, at no cost to the SFWIB, all public records created, received, maintained and/or and or directly related to the performance of this Purchase Order Contract that are in possession of the Contractor upon termination of this Purchase OrderContract. Upon termination of this Purchase OrderContract, the Contractor shall destroy any duplicate public records that are exempt and/or or confidential and exempt from public records disclosure requirements. Florida Public Records Law. 1. The Contractor shall allow public access to all documents, papers, letters, or other materials material subject to the provisions of Chapter 119, Florida Statutes, made or received by the Contractor in connection with this Purchase OrderContract, except that public records which are made confidential or exempt and/or confidential from public records record disclosure by law must be protected from disclosure and includesinclude, but is not limited to, to criminal history information derived from the U.S. Department of Justice. b) Upon request from the SFWIB’s custodian of public records, provide the SFWIB with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in this chapter or as otherwise provided by law;
c) Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the contract term and following completion of the purchase order contract if the Contractor contractor does not transfer the records to the SFWIB; and
d) Meet all requirements for retaining public records and transfer to the SFWIB, at no cost to the SFWIB, all public records created, received, maintained and/or and or directly related to the performance of this Purchase Order Contract that are in possession of the Contractor upon termination of this Purchase OrderContract. Upon termination of this Purchase OrderContract, the Contractor shall destroy any duplicate public records that are exempt and/or or confidential and exempt from public records disclosure requirements. All records stored electronically must be provided to the SFWIB SFWIB, upon request from the SFWIB’s custodian of public records, in a format that is compatible with the SFWIB’s information technology systems.
