Following notification of a Change of Control the Authorised Representative shall be entitled to exercise its rights under paragraph 26.1 of these Conditions providing the Grant Recipient with notification of its proposed action in writing within three (3) months of:
(i) being notified in writing that a Change of Control is anticipated or is in contemplation or has occurred; or
(ii) where no notification has been made, the date that the Authority, or its Authorised Representative, becomes aware that a Change of Control is anticipated or is in contemplation or has occurred,
Following notification of a Change of Control the Department shall be entitled to exercise its rights under Condition 26.16 providing the Grantee with notification of its proposed action in writing within three (3) months of:
(a) being notified in writing that a Change of Control is anticipated or is in contemplation or has occurred; or
(b) where no notification has been made, the date that the Department becomes aware that a Change of Control is anticipated or is in contemplation or has occurred,
Following notification of a Change of Control the Funder shall be entitled to exercise its rights under paragraph 27.3 of these Conditions by providing the Grant Recipient with notification of its proposed action in writing within three (3) months of:
(i) being notified in writing that a Change of Control is anticipated or is in contemplation or has occurred; or
(ii) where no notification has been made, the date that the Funder becomes aware that a Change of Control is anticipated or is in contemplation or has occurred.
Following notification of a Change of Control the Lead Authority shall be entitled to exercise its rights under paragraph 27.3 of these Conditions by providing the Grant Recipient with notification of its proposed action in writing within three (3) months of:
(i) being notified in writing that a Change of Control is anticipated or is in contemplation or has occurred; or
(ii) where no notification has been made, the date that the Lead Authority becomes aware that a Change of Control is anticipated or is in contemplation or has occurred.
Following notification of a Change of Control the Secretary of State shall be entitled to exercise its rights under paragraph 26.3 of these Conditions by providing the Lead Authority with notification of its proposed action in writing within three (3) months of:
(i) being notified in writing that a Change of Control is anticipated or is in contemplation or has occurred; or
(ii) where no notification has been made, the date that the Secretary of State becomes aware that a Change of Control is anticipated or is in contemplation or has occurred.
