Common use of Footings and Foundations Clause in Contracts

Footings and Foundations. Seller has the right to void Agreement if Seller discovers soil or lot conditions that require the use of an engineered footing or foundation, or if Seller is unable to build selected plan on Property for any reason. Seller will provide written notice to Buyer within 10 days of the discovery of such condition(s) and its decision to void and cancel this Agreement. If such condition(s) occurs, the Buyer’s xxxxxxx money and any Construction Deposits will be promptly refunded.
