FORGIVENESS OF UNCOLLECTED OVERDRAFT FEES. Upon the occurrence of the Effective Date, Defendant also shall forgive and release any claims it may have to collect any Sufficient Funds Overdraft Charges and Regulation E Overdraft Charges that have been assessed against Class Members but not collected by Defendant.

FORGIVENESS OF UNCOLLECTED OVERDRAFT FEES. Uncollected Overdraft Fees shall be forgiven in full within 10 days after the Effective Date. Defendant shall update any negative reporting to Chexsystems or credit reporting agencies with respect to Settlement Class Members who receive forgiveness of Uncollected Overdraft Fees.
FORGIVENESS OF UNCOLLECTED OVERDRAFT FEES. Defendant shall forgive all Uncollected Overdraft Fees as defined in Section 1(aa).

The parties intend this provision, if applicable, to be a continuing right to terminate this at the expiration of each budget period of County in accordance with Tex. Loc. Govt. Code §271.903 (Xxxxxx Supp. 1996).
