Form Documents. No terms, provisions or conditions of any purchase order, order acknowledgement, quote, proposal, invoice or other business form or written authorization used by either Party will have any effect on the rights or obligations of the Parties under, or otherwise modify, this Agreement, regardless of any failure of the other Party to object to such terms, provisions or conditions, except to the extent that such document refers to this Agreement, explicitly states that the terms thereof take precedence, and is signed by an authorized representative of each of the Parties.
Form Documents. The terms of this Agreement shall govern the sale by Silgan and the purchase by Del Monte of Containers. Form documents used by either party shall serve only to identify the Containers ordered or delivered and shall not be deemed to alter or otherwise modify this Agreement in any manner whatsoever.
