Common use of Form of transport Clause in Contracts

Form of transport. and health status* on receipt The form of transport* influences the health status* the weaners have when they are unloaded at the recipient herd*. The agreed form of transport* shall be stipulated in the Business Agreement*. The following forms of transports* exist: a) "SPF vehicle*": The weaners are transported in SPF vehicles* directly from the Supplier Herd* and delivered to the Buyer* with Health Status*, which is the same as the Supplier Herd’s*. b) "Open vehicle*": The weaners are transported in either an SPF vehicle* or in an open vehicle* and are delivered to the Buyer* with health status*: "Unknown". When form of transport* "open vehicle*" is used, SPF* accepts no liability whatsoever for: 1) the health status* of the weaners on delivery*, with the exception of the provisions of clause 3.4, and 2) the health-related sequence of transports, with the exception however of: a. transport sequences involving departures and arrivals at herds with health status*: conventional with PRRS declaration, where the sequence is as stipulated in the Transport Rules* b. transport sequences that are demanded by the authorities or the Pig Research Centre including unloading and sojourn at EU approved assembly centres or places of rest or transfer. In relation to the Transport Rules*, an open vehicle* shall be considered to be a non-approved carrier's vehicle.
