FORTE’s Confidentiality. In performing its duties under this Agreement, FORTE agrees to safeguard and protect Merchant’s confidential information, in the same manner it safeguards and protects its own confidential information, but in any event using no less than reasonably prudent care and at all time consistent with applicable Laws, including those Laws relating to privacy and security of non-public consumer financial information.
