FRAUDULENT EFFECTS. The accountholder xxxxxx agrees that in the event that the Bank pay or honor an effect which the accountholder has claimed as fraudulent, submit to the Bank an affidavit to that effect signed by a notary public, and the Bank is not bound to consider the accountholder's claim until it has been heard that statement in the Bank. Any payment made by the Bank under such claims shall not be deemed a waiver by the Bank of its rights under this paragraph.

FRAUDULENT EFFECTS. The Depositor agrees that in case the Bank pays or honors an effect which the Depositor claims is altered or falsified, or that the signature of the one who draws, or the endorser is falsified, the Depositor will present the Bank with a Sworn Declaration before a public notary with an apostille, as necessary, for such purposes. The Bank will not be obliged to consider the claim of the Depositor, until such declaration is received. In case of falsification or alteration of fraudulent checks, the Bank reserves the right to attribute said negligence or willful act to the Depositor.
