Free Exercise of Rights. The Contractor must ensure that each Individual is free to exercise his or her rights, and that the exercise of those rights does not adversely affect the way the Contractor and its providers treat the Individual. 11.4.1. The Contractor must establish policies and procedures to ensure that the exercising of any of these rights does not adversely affect the way the Contractor treats the Individual. 11.4.2. The Contractor must require that mental health professionals, MHCPs, and CDP/CDPTs acting within the lawful scope of their practice are not prohibited or restricted from advising or advocating on behalf of an Individual with respect to: 11.4.2.1. The Individual’s behavioral health status. 11.4.2.2. Receiving all information regarding behavioral health treatment options including any alternative or self-administered treatment, in a culturally-competent manner. 11.4.2.3. Receiving any information the Individual needs in order to decide among all relevant behavioral health treatment options. 11.4.2.4. Receiving information about risks, benefits, and consequences of behavioral health treatment (including the option of no behavioral health treatment). 11.4.2.5. The Individual’s right to participate in decisions regarding his or her behavioral health care, including the right to refuse behavioral health treatment and to express preferences about future treatment decisions. 11.4.2.6. The Individual’s right to be treated with respect and with due consideration for his or her dignity and privacy. 11.4.2.7. The Individual’s right to be free from any form of restraint or seclusion used as a means of coercion, discipline, convenience, or retaliation. 11.4.2.8. The Individual’s right to request and receive a copy of his or her medical records and to request that they be amended or corrected, as specified in 45 CFR Part 164. 11.4.2.9. The Individual’s right to be free to exercise his or her rights and to ensure that doing so does not adversely affect the way the Contractor, MHCP, or CDP/CDPT treats the Individual. 11.4.2.10. Any of the Individual’s Rights and Protections as listed in the Washington Medicaid Behavioral Health Benefits Booklet published by HCA.
