Free from Deficiencies. (a) On completing the Inspection and identifying any Deficiencies pursuant to clause 4.1, the Purchaser shall sign the Declaration of Adherence and Acknowledgement in favour of the Seller confirming that the Purchaser has inspected the Unit and has accepted the physical state and condition of the Unit. (b) Where the Purchaser fails to inspect the Unit on the date agreed with the Project Manager or respond and/or arrange an inspection in accordance with clause 4.1, the Project Manager shall undertake such inspection on behalf of the Purchaser and Unit shall be deemed to be free of any Deficiencies other than those identified by the Project Manager during such inspection and it shall be deemed that the Purchaser confirmed the Deed of Adherence and Acknowledgment. (c) If the Purchaser does not respond to the Completion Notice or arrange an inspection in accordance with clause 4.1(a) the Purchaser shall be deemed to accept the all risks associated with the Unit and the handover of the Unit on the Completion Date free from any Deficiencies and it shall be deemed that the Purchaser confirmed the Deed of Adherence and Acknowledgment.
