Freight Forwarding Services. Unless agreed otherwise, in case Lineas organizes a carriage of goods by road, in addition or not to a carriage of the Goods by rail, and/or a carriage of goods by rail without executing the carriage of the Goods by rail itself, Lineas shall act as forwarding agent (comissionair-expediteur) according to Belgian Law for the organisation of such carriage. The duties of a forwarding agent (comissionair-expediteur) consist of forwarding goods either in his own name or in his principal’s name, but always on the latter’s behalf. Lineas as forwarding agent shall perform its duties with reasonable care, dedication and perception, and he shall be under a duty of normal professional performance of the instructions given to him. The liability of Lineas as forwarding agent shall be limited to that for fault, negligence or omission in the performance of the instructions given to him. Lineas as forwarding agent shall not be liable for the performance of any contract entered into by him for and on behalf of his Customer with third parties, servants or agents, pertaining to storage, transport, customs clearance or the handling of goods, unless it is shown by the Customer that the defective performance thereof was directly caused by the freight forwarder’s fault. Lineas as forwarding agent does not guarantee any fixed time or date for delivery, dates of arrival and departure, unless otherwise previously agreed in writing. The indication of a time or date for delivery by the principal is not binding upon the freight forwarder.

Freight Forwarding Services. Article 6 In addition to these General Conditions, MANORA and Customer’s duties and liabilities as they relate to Freight Forwarding services shall be performed on the basis of the Belgian Freight Forwarders Standard Trading Conditions, latest version, available in the Supplements to the Belgian Official Gazette (Belgisch Staatsblad – Moniteur belge) of 24 June 2005 under number 0090237 (“Belgian Standard Conditions”). The text of the said conditions will be sent upon request. Article 7 All transports carried out by MANORA in its capacity as a Freight Forwarder, both domestically and internationally, shall be performed in accordance with the international treaties and legislation applicable to the related transport. Article 8 Unless otherwise and previously agreed in writing, MANORA shall not be under a duty to guard the goods to be forwarded, nor to have them guarded, nor to have them insured.
Freight Forwarding Services. The Principal authorizes the Agent to undertake the freight forwarding business from their territory under the Principal’s Xxxx of Lading and the contract of affreightment detailed therein, with effect from the 21st day of October, 2011, subject to specific approval being obtained for each such case and any claims or liabilities arising being to the account of the Agent.
Freight Forwarding Services. AII shall also provide to AG Worldwide all freight forwarding and shipping services necessary to insure that inventory arrives in a timely manner at the proper destination. AII shall invoice AG Worldwide separately for all such services provided, at a price equal to AII’s cost of obtaining such services.

  • Janitorial Services Tenant will not employ any person for the purpose of cleaning the Premises or permit any person to enter the Building for such purpose other than Landlord's janitorial service, except with Landlord's prior written consent. Tenant will not necessitate, and will be liable for the cost of, any undue amount of janitorial labor by reason of Tenant's carelessness in or indifference to the preservation of good order and cleanliness in the Premises. Janitorial service will not be furnished to areas in the Premises on nights when such areas are occupied after 9:30 p.m., unless such service is extended by written agreement to a later hour in specifically designated areas of the Premises.

  • Ordering Services a) By submitting an Order to Megaport: 1. Customer warrants that the information Customer provides to Megaport in an Order is true and correct and that Megaport may rely upon it; and 2. Customer is making a binding offer to acquire the Services described in the Order on the terms set out in this Agreement, which Megaport may accept at its discretion.
