Future Changed Circumstances. If the District decides not to pursue the said Facilities plan or is unable to pursue the Facilities plan within one (1) year of the date of this Agreement, the Pledged Funds will be returned to the Grantor unless Grantor expressly authorizes, through written modification of this Agreement, that the Pledged Funds may be used by the District for such other purposes or purposes as Grantor designates. Any interest that may accrue on the Pledged Funds between the date of receipt of any of the Pledged Funds and the date of return of the Pledged Funds shall be the property of the District.
Future Changed Circumstances. If, in the opinion of the Board of Directors of the Foundation, all or part of this gift cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose cannot be achieved because of a future change in law or unforeseeable circumstances, the gift may be used for any related purpose which, in the opinion of the Board of Directors of the Foundation, will most nearly accomplish the Donor’s wishes.
Future Changed Circumstances. If, in the opinion of the Board, all or part of the Fund cannot at some time in the reasonably foreseeable future be usefully or practically applied to the stated purposes or if the purposes cannot be achieved because of a future change in law or unforeseeable circumstances, the Foundation may use the Fund for any related purpose which in the opinion of the Board will most nearly accomplish the stated purposes. Should the Foundation cease to exist, the principal of the Fund will be distributed in the manner provided in the Articles of Incorporation of the Foundation.
Future Changed Circumstances. If, in the opinion of the University , all or part of this gift cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose cannot be achieved because of a change in law or unforeseeable circumstances, it may be used for any related purpose(s) which in the opinion of the University, in consultation with the Donors so long as they are living and with the Quantitative Foundation so long as it exists, will most nearly accomplish the purpose described in paragraph 4 above.
Future Changed Circumstances. If, in the opinion of the Aquatic Center, all or part of this pledge cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose cannot be achieved because of a future change in law or unforeseeable circumstances, it may be used for any related purpose which in the opinion of the Aquatic Center will most nearly accomplish the Donor’s wishes expressed herein.
Future Changed Circumstances. Should the entities referenced in the Endowment Summary restructure in the future, the terms of the endowment shall apply to the successors in interest. A restriction as to the use of the Fund may be released in whole or in part if the Fund cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose has become obsolete or cannot be achieved because of a future change in law or unforeseeable circumstances. In such case the Board of Trustees of the School with the written consent of the Donor and without court approval shall designate the Fund to an alternative fund which follows as closely as reasonably practicable the intent of the Donor set forth in this Agreement. In the event the written consent of the Donor cannot be obtained at such time because of the Donor’s death, disability, unavailability or impossibility of identification, the Donor hereby authorizes the Board of Trustees to designate the alternative fund without such Xxxxx’s consent and without court approval. The School reserves the right to remove the name of the Fund if at any time following the approval of the Fund, circumstances change so that the continued use of the name may compromise the integrity or reputation of the School.

[Note that this provision is not necessary for unrestricted gifts, but should be used for all others.] If, in the opinion of the Xxxxxx and Visitors of the University of Virginia [or Foundation], all or part of this gift cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose can not be achieved because of a future change in law or unforeseeable circumstances, it may be used for any related purpose which in the opinion of the Xxxxxx and Visitors [or Foundation] will most nearly accomplish the Donor’s wishes.
Future Changed Circumstances. If, in the opinion of the HOHW Grant Committee, all or part of this gift cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose cannot be achieved because of a future change in law or unforeseeable circumstances, it may be used for any related purpose which in the opinion of the HOHW Grant Committee will most nearly accomplish the Donor’s wishes.
Future Changed Circumstances. If, in the opinion of the Board of Directors of RCAS, all or part of this contribution cannot at some time in the future be usefully or practically applied to the above purposes or if the purpose cannot be achieved because of a future change in law or unforeseeable circumstances, it may be used for any related purpose which in the opinion of the Board of Directors will most nearly accomplish the Donor’s wishes.
Future Changed Circumstances. If in the future Drexel determines it is necessary to deviate from any gift or donation agreement, bequest, deed of trust, or other restriction regarding a Collection object, Drexel shall seek approval from (A) the object donor (or other party with the legal interest in the object to validly grant the approval), if living, or their designated successor representative, if any, (B) the Office of Attorney General of the Commonwealth of Pennsylvania (the “Attorney General”) as parens patriae, and (C) the court with appropriate jurisdiction, as applicable or otherwise required by law.
