Common use of Gardens Clause in Contracts

Gardens. 7.4.1 You, or any other person living in the property, must: (i) keep your garden in a well maintained condition (this includes cutting the grass and trimming xxxxxx); (ii) ensure that any xxxxxx do not grow more than two metres high; (iii) ensure that plants, trees, boundary xxxxxx or large shrubs, do not become dangerous or overgrown, cause nuisance to your neighbours or damage to property; (iv) not store or hold any rubbish (with the exception of wheelie bins), household furniture or appliances in your garden area, except where you are awaiting their collection within 10 working days; (v) not cause any nuisance, annoyance, disturbance, potential risk or harm to your home or neighbouring properties by burning hazardous materials. You should give your neighbours fair consideration whenever you light bonfires in your garden; and (vi) not do anything to encourage pests or vermin into the property or any communal or garden areas. 7.4.2 You must obtain written permission from us (we will not unreasonably withhold permission) before you, or any other person living in the property wish to do any of the following: (i) place, build or erect any greenhouse, garage, shed, patio, decking, aviary, fencing, conservatory, pigeon-loft, fishpond, pool or similar structure in your garden area or anywhere in the property. (It is your responsibility to ensure that you have also obtained all necessary legal consents including planning permission and that you comply with building regulations. You will need to send us copies of any permissions that are necessary); (ii) place, build or erect any gate or barrier across a communal path; (iii) remove any trees, shrubs, xxxxxx or fences or plant new xxxxxx; (iv) replace or erect fencing. Where we allow fencing, it should be no higher than one metre at the front or two metres at the back of the property. 7.4.3 You must not erect or plant fencing or xxxxxx where there are open-plan shared areas.

Gardens. 7.4.1 You9.1 You must keep the Property garden clean and tidy and the paths free from obstruction. You must maintain the garden, including xxxxxx, fences, lawns and borders to the satisfaction of the Director of Environment and Neighbourhood Services. You must not allow any hedge to grow more than 2 metres high or any other person living lesser height as specified by us in writing 9.2 You must not use the garden to store rubbish, scrap or unsightly objects 9.3 You must obtain the Councils prior written permission before the erection or removal of garden structures (garage, greenhouse, shed, pond etc), fences, xxxxxx and the planting or removal of trees, shrubs or bushes 9.4 Failure to maintain the garden may result in the propertyCouncil, must:after giving 24 hours notice, entering the garden and carry out any necessary works to ensure that the tenancy conditions are met. You will be charged for the cost of such works (i) keep your garden in a well maintained condition (9.5 If the Property is on an open-plan estate the front must remain lawned. You must not plant anything or erect any structures, including fencing, on this includes cutting area unless you have obtained the grass and trimming xxxxxx);Councils prior written permission to do so. You must not park on or drive across any estate grassed verges, open areas or gardens (ii) 9.6 You must not remove or interfere with any trees, xxxxxx or fencing that belong to the Council unless you have obtained the Councils prior written permission to do so 9.7 You must ensure that any xxxxxx do structure or planting within the garden of the Property does not grow more than two metres high; (iii) ensure that plants, trees, boundary xxxxxx or large shrubs, do not become dangerous or overgrown, cause nuisance to your neighbours or damage to property; (iv) not store or hold any rubbish (interfere with the exception of wheelie bins)public footpath, household furniture highway, entrance or appliances exit to the Property or in your garden area, except where you are awaiting their collection within 10 working days; (v) not cause any nuisance, annoyance, disturbance, potential risk anyway causes a nuisance or harm annoyance to your home or neighbouring properties by burning hazardous materials.
