Geographical Indications. Each Party shall ensure adequate and effective protectionof geographical indications in accordance with its laws andregulations and with the TRIPS Agreement.
Geographical Indications. 1. The terms listed in Annex 2A are geographical indications in China, within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement. Subject to domestic laws and regulations, in a manner that is consistent with the TRIPS Agreement, such terms will be protected as geographical indications in the territory of the other Party.
2. The terms listed in Annex 2B are geographical indications in Chile, within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement. Subject to domestic laws and regulations, in a manner that is consistent with the TRIPS Agreement, such terms will be protected as geographical indications in the territory of the other Party.
Geographical Indications. The Parties shall protect the geographical indications for their products according to their rights and obligations set out in the Agreement on Trade Related Intellectual Property Rights, Annex 1C of the WTO Agreement, and any successor agreement to which both Parties are party.
Geographical Indications. Definition
1. For purposes of this Article, geographical indications are indications that identify a good as originating in the territory of a Party, or a region or locality in that territory, where a given quality, reputation, or other characteristic of the good is essentially attributable to its geographical origin. Any sign or combination of signs, in any form whatsoever, shall be eligible to be a geographical indication.
Geographical Indications. 1. For the purposes of this Article, the term "geographical indications" shall have the same meaning as in paragraph 1 of Article 22 of the TRIPS Agreement. Nonetheless, nothing in this Agreement shall require a Party to amend its laws and regulations on the protection of geographical indications or on the protection of appellations of origin which are consistent with the TRIPS Agreement.
2. Each Party shall ensure adequate and effective protection to geographical indications, in accordance with the TRIPS Agreement and in the manner set out in its laws and regulations. 3. Each of the indication(s) for wines and spirits listed in paragraph 1 of Annex 10 identifies a good as originating in Japan where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin and is protected as a geographical indication within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement under the laws and regulations of Japan. Peru agrees that each of the indication(s) listed in paragraph 1 of Annex 10 is a geographical indication within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement and as such is qualified for protection as a geographical indication in Peru subject to provisions in Section 3 of Part II of the TRIPS Agreement and to Peru's domestic laws and regulations. 4. Each of the indication(s) for wines and spirits listed in paragraph 2 of Annex 10 identifies a good as originating in Peru where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin and is protected as a geographical indication within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement under the laws and regulations of Peru. Japan agrees that each of the indication(s) listed in paragraph 2 of Annex 10 is a geographical indication within the meaning of paragraph 1 of Article 22 of the TRIPS Agreement and as such is qualified for protection as a geographical indication in Japan subject to provisions in Section 3 of Part II of the TRIPS Agreement and to Japan's domestic laws and regulations. 5. Subject to consultations and by mutual consent, the Parties may modify Annex 10 as to geographical indications of the Parties to be protected under this Article. Such modifications shall be confirmed by an exchange of diplomatic notes.
Geographical Indications. Protection in the country of origin
Geographical Indications. 1. Each Party shall recognize and protect the geographical indications and appellations of origin of another Party, as established in this Article.
2. No Party shall permit the importation, manufacture or sale of a good that uses a geographical indication or appellation of origin protected in another Party, unless it has been manufactured and certified therein, pursuant to its legislation applicable to that good.
3. Paragraphs 1 and 2 shall only have effect with respect to those geographical indications and appellations of origin protected by the domestic legislation of the Party that is claiming protection and whose definition is consistent with Article 22 (1) of the Agreement on Trade-Related Aspects of Intellectual Property Rights, which is part of the WTO Agreement. Further, to gain protection, each contracting Party shall notify the other Parties of the geographical indications or appellations of origin which, fulfilling the above-mentioned requirements, shall be considered within the scope of the protection.
4. All of the above shall be understood without prejudice to the recognition that the Parties may grant to homonymous geographical indications and appellations of origin that legitimately could belong to a non-Party.
Geographical Indications. 1. If a Party provides the means to apply for protection or petition for recognition of geographical indications, through a system of protection of trademarks or otherwise, it shall accept those applications and petitions without the requirement for intercession by a Party on behalf of its nationals, and shall:
(a) process applications or petitions, as the case may be, for geographical indications with a minimum of formalities;
(b) make its regulations governing filing of such applications or petitions, as the case may be, readily available to the public;
Geographical Indications. 1. The Parties recognise the importance of geographical indications for sustainable agriculture and rural development.
2. The Parties agree to cooperate in the identification, recognition and registration of products that could benefit from protection as geographical indications and any other action aimed at achieving protection for products so identified.
