Grievance Administration Issues. Each party shall be responsible for paying the costs of presenting its own case in arbitration, including the payment of witness fees, if any. The cost of the arbitrator and hearing room shall be borne by the losing party. If mutually agreed prior to arbitration, the cost of transcription of the hearing shall be shared equally. If there is a dispute regarding who is the “losing party”, the arbitrator will be asked to rule on that issue. If the arbitrator cannot or does not designate which party is the loser, each party will pay one-half (1/2) of the cost of the arbitration.

If mutually agreed prior to arbitration, the cost of a court reporter, if any, shall be paid in accordance with the bar/court reporting guidelines, with each party sharing fifty percent (50%) of the court reporter's fees and the cost of a transcript for the arbitrator, and each party bearing its own expenses for its copy of the record. Following the rendering of the arbitrator's decision, the parties shall meet and attempt to agree which is the "losing party." If the parties are unable to so agree, the question of who the "losing party" is shall be submitted to the arbitrator who rendered the decision in question. The arbitrator's subsequent designation of the "losing party" shall be final and binding. If the arbitrator cannot designate which party is the loser, each party will pay one-half (1/2) of the cost of the arbitration. Days shall be counted as calendar days.
