GRIEVANCE/APPEAL RIGHTS. A. An employee who is dissatisfied with the Agency's decision to effect an adverse action may elect to either appeal the decision in accordance with 5 U.S.C. 7701 or 7702 as applicable, or grieve the decision in accordance with the negotiated grievance procedure (Article 36) but not both. B. An employee who is dissatisfied with the Agency's decision to effect a disciplinary action may elect to grieve the decision in accordance with the negotiated grievance procedure (Article 36).
