Gross Up and Rentable Area Calculations. For the purpose of computing the annual amount of Operating Costs per square foot of Rentable Area, Rentable Area for each entire Building shall be deemed to be the greater of ninety-five percent (95%) of the Rentable Area of each entire Building or the average number of square feet of Rentable Area of each Building actually occupied by tenants during the calendar year with respect to which the calculation is being made. For purposes of calculating the foregoing, Rentable Area for each entire Building shall be determined by averaging the Rentable Area of vacant and occupied space as shown on Landlord’s monthly accounting reports prepared in the normal course of business. Landlord and Xxxxxx agree that at any time after Xxxxxx takes possession of the Premises, Landlord may elect to recalculate the Rentable Area of the Premises and the Rentable Area of the Building.
