Common use of Hazardous Materials and Pollution Liability Insurance Clause in Contracts

Hazardous Materials and Pollution Liability Insurance. (a) In the event the Licensee or any sublicensee enters into a contract with another entity that involves abatement, removal, repair, replacement, enclosure, encapsulation and/or delivery, receipt, or disposal of any petroleum products, asbestos, lead, PCBs or any other hazardous materials or substances, the Licensee shall maintain, or cause the contractor to maintain, Contractors Pollution Liability Insurance covering bodily injury, property damage, cleanup costs/remediation expenses and legal defense costs. Such insurance shall provide coverage for sudden and non-sudden pollution conditions arising out of the contractor’s operations at the Premises.
