Workplace Safety Insurance. 27.1 Each member covered by this Agreement who is absent on account of injuries received while on duty and who is receiving a pension, salary or wage award from the Workplace Safety and Insurance shall be entitled to be paid the difference between the pension wage or salary award from the Workplace Safety and Insurance Board and his or her current net salary as long as such member remains in the employ of the Niagara Police Board. This shall be applied such that the combination of any WSIB salary or wage award plus the employer top-up shall, in total, equal the net pay of the member's current salary. The non-economic loss portion of any WSIB pension payments shall not be considered as being a salary or wage award, and hence shall not form part of these calculations. A member who does not comply with the provisions of the Workplace Safety & Insurance Act or Regulations thereto and subsequently receives a salary or wage award of an amount less than the prevailing maximum payable due to such non-compliance, shall not receive from the Niagara Police Board the difference between the wage or salary award paid by the Workplace Safety & Insurance Board and his or her current net salary for the said period of six (6) months. For the purpose of this Clause, net pay shall be the pay for the member as shown in Appendix "A" less those deductions required under Government Statutes, pension plans and as provided for in this Agreement.
27.2 Subject to the terms of this Article, each member covered by this Agreement who is injured as a result of carrying out his/her duties shall not be deprived of his/her vacations or statutory holidays as a result thereof, and shall accumulate such vacation credits and statutory holidays as he/she might otherwise receive.
27.2.1 Each member shall be entitled to accumulate the float time that he/she might otherwise receive for a period of three (3) months following the injury.
27.2.2 In respect of members who have been off work and receiving WSIB benefits for less than two (2) consecutive calendar years, within one week of the member's return, the member and the Chief of Police or designee shall mutually agree upon when the vacation credit, statutory holidays and float time shall be taken within the following twelve (12) months, or in the alternative, the member may elect to be paid for same at the rates of pay applicable in the year of accrual.
27.2.3 In respect of members who have been off work and receiving WSIB benefits for two
Workplace Safety Insurance. 6.1 For the purposes of Article 41.2 (Workplace Safety & Insurance) of the Central Collective Agreement “sixty-five (65) working days” shall be deemed to be (471¼ or 520) hours.
Workplace Safety Insurance.
24.01 (F/T)
(a) If a full-time Employee is injured on the job and his/her Supervisor excuses him/her from further duty for the balance of the shift, the Employee's regular rate of pay shall continue for the balance of that shift and there shall be no deduction from sick leave or other credits. (P/T)
(b) If a part-time Employee is injured on the job and his/her Supervisor excuses the Employee from further duty for the balance of the shift, the Employee's regular rate of pay shall continue for the balance of that shift.
(a) The Employer shall advance to the Employee a percentage of the Employee's net average earnings as per W.S.I.B. legislation, until such time as Workplace Safety Insurance benefits are processed, if the duration of an approved Workplace Safety Insurance claim exceeds two (2) weeks. The Employee must file a separate request for each two (2) week period.
(b) Although there will be no assignment of W.S.I.B. payments, the claimant must immediately reimburse the Employer upon receipt of W.S.I.B. benefits for any advance of funds provided for in this clause. If a claim is disallowed by the W.S.I.B. the Employee shall reimburse any advances given and shall not be eligible for further advances.
(c) This provision shall not apply in the event of lump sum or permanent disability awards.
24.03 The Employer shall meet its obligations outlined in the Workplace Safety Insurance Act to re-employ Employees who are or have been in receipt of Workers' Compensation.
24.04 (F/T) A permanent Employee on Workplace Safety Insurance benefits shall continue to accumulate seniority for a maximum period of twelve (12) months and shall retain his/her seniority thereafter, without further accumulation.
24.05 (P/T) Calculation of seniority for part-time Employees on Workplace Safety Insurance, (in receipt of benefits) shall be the average of time worked per week using the preceding six (6) months' work record before the accident. An Employee shall continue to accumulate seniority for a maximum period of twelve (12) months and shall retain his/her seniority thereafter without further accumulation.
24.06 Continuation of Benefits While on W.S.I.B. (F/T) The Employer will continue the Employer's portion of hospital, medical, dental and group life insurance premiums during any period of absence on Workplace Safety Insurance to a maximum of two (2) years.
24.07 Workplace Accommodations
(a) Employees who request workplace accommodation will be given the option to have Union ...
Workplace Safety Insurance. All nurses included in this Agreement shall continue to be covered by the provisions of the Ontario Workplace Safety & Insurance Act and shall be subject to the rules and regulations of the aforementioned Act.
(a) A nurse who is incapacitated and unable to work as a result of an accident sustained while on duty in the service of the Employer within the meaning of the Workplace Safety & Insurance Act, shall continue to receive her regular salary from the Employer, less regular deductions during the waiting period, provided she assigns over to the Employer her compensation payments due from the Workplace Safety & Insurance Board for the waiting period.
(b) A nurse who elects not to assign her Workplace Safety & Insurance Compensation payments to the Employer may make prior arrangements for the prepayment of the full premium of any contributory health benefits plans.
(c) Should the nurse's claim be disallowed by the Workplace Safety & Insurance Board, then any monies paid by the Employer shall be either charged against the nurse's accumulated sick leave credits, or if the nurse has no sick leave credits, the amount so paid shall be recovered from the nurse over a reasonable period of time.
(d) When a nurse is absent on Workplace Safety & Insurance claim, all benefits of this Agreement will continue to accrue subject to 15.08 e) below.
(e) A nurse who is absent on a Workplace Safety & Insurance claim will not accrue annual vacation and designated paid holidays with pay during the entire period of absence. However, service credits for the purpose of calculating future vacation entitlement and sick leave will continue during such absence. Should an anniversary increment fall during such leave, the nurse shall receive her anniversary increment upon her return to employment.
(f) A nurse shall lose her seniority and employment on the date when she is declared permanently unfit to perform her regular duties or, on the date as of which a physician certifies the employee fit to return to work and she fails to do so. In the case of nurses who are hired for a definite term of employment, upon expiration of such term, whichever occurs first.
(g) All accidents must be reported immediately by the nurse to the Assistant Manager who will discuss it with the Centre Director prior to filling out the accident report. The nurse will be provided with a copy of the report if requested.

Workplace Safety Insurance. The University pays premiums annually to the Workplace Safety and Insurance Board (WSIB) based on an amount per $100.00 of assessable earnings for each employee in accordance with the rates set annually by the Workplace Safety and Insurance Board. The Workplace Safety and Insurance Board provides compensation and/or medical aid to employees who, as a result of an accident related to their work, are injured to the extent that they experience a loss of time from work. Employees who suffer an injury at work must immediately report this injury to their supervisors who in turn must immediately report this injury to the Health and Safety Office (Department of Risk Management). This procedure should be followed whether or not the injury is severe enough to warrant loss of time from work and/or medical aid. A report is filed with WSIB immediately. Such a procedure aids in the establishment of claims at a later date, if necessary, and in the correction of safety hazards in the University work place. The University is required to pay fines to WSIB for late filing of accident reports.
Workplace Safety Insurance. If a claim for Workplace Safety Insurance benefits is made by the Employer on behalf of a full-time employee, said full-time employee may, in return for turning over all monies received for said benefits, elect to receive full salary from the full-time employee’s accumulated sick bank until such time as the claim is adjudicated in the full-time employee’s favour. At such time, the full-time employee will be entitled to assign the Workplace Safety Insurance benefits to the Employer in exchange for bi-weekly advances equivalent to the Workplace Safety Insurance entitlement. In addition, the qualifying full- time employee will be entitled to full restoration of the sick bank to the pre-accident amount.
Workplace Safety Insurance. The Artist will comply with the Workplace Safety and Insurance Act, 1997, S.O. 1997, c.16, Schedule A. The Artist will, upon request, either:
(i) submit to the City a valid clearance certificate from the Ontario Workplace Safety and Insurance Board and will provide additional certificates with respect to such coverage as often as the City deems necessary during the term of this Agreement to ensure continued good standing with the Workplace Safety and Insurance Board; or
(ii) furnish proof in a form satisfactory to the City from the Workplace Safety and Insurance Board that the Artist does not require Workplace Safety and Insurance Board insurance, but in such a case, if the Artist changes his/her status during the term of this Agreement so that such coverage is required, the Artist will immediately provide the City with the certificate required under clause (i).
Workplace Safety Insurance. Each employee who is injured in the course of duty shall have the Workplace Safety and Insurance Board salary awards supplemented from sick leave account to provide for payment of full salary. In the event that an employee does not wish to use sick leave credits to supplement the Workplace Safety and Insurance Board award, the employee must give immediate notice in writing to the Human Resources Department. After the expiration of any Workplace Safety and Insurance Board award, the employee may use the current year's sick leave or accumulated credits up to the limit previously established. It should be understood that there shall be no pyramiding or compounding of Board benefits with any other internal or external benefit. An employee on sick leave shall not be able to earn an amount of income greater than that which the employee earned while actively at work.
Workplace Safety Insurance. 8.1. The Corporation will include the Artist as a contractor for purposes of the Workplace Safety & Insurance Board. The Artist agrees to indemnify and save harmless the Corporation from any claims made by it or its contractors.
Workplace Safety Insurance. (a) An employee injured while and as a result of performing his/her Company’s duties will suffer no loss of basic pay on the day he/she was injured providing in the opinion of the Company or a doctor the employee was unable to continue working.
(b) If an employee is injured in the course of performing work duties assigned by the Company and as a result of such injury is in receipt of payment by the Workplace Safety Insurance Board for time lost, the Company shall pay the difference between the amount received by the employee from the Workplace Safety Insurance Board for lost basic wages and the amount he/she would have received for his/her basic wage had he/she not been injured. Under no circumstances shall the Company continue the make-up of the difference beyond three (3) calendar months from the day the employee became entitled to Workplace Safety Insurance Board payment. Basic pay is defined as the amount received by an employee for seven and one-half (71/2) hours work per day or thirty- seven and one-half (37 1/2) hours per week as the case may be, excluding shift premiums, overtime and standby compensation. This Section 10:02 (b) does not apply to probationary employees. It is understood and agreed that any payment by the Company which exceeds an amount greater than his/her basic wage when such an amount is combined with his Workplace Safety Insurance Board payment, then the excess payment shall be refunded to the Company.
