If this condition is breached, the Hirer must pay to JUCY a cleaning fee determined by JUCY in its reasonable opinion and being not more than $250. e) The Hirer must ensure that all Authorised Drivers comply with, and all Authorised Drivers shall be bound by, these terms and conditions and all Authorised Drivers must carry their driver’s licence with them when driving the Vehicle. f) In the event of any new damage to the Vehicle, the Hirer must notify JUCY of the full circumstances of the damage as soon as practicable (being not more than 48 hours) from the time the Hirer has knowledge of the damage. g) If there is an equipment defect or mechanical failure of the Vehicle during the Term of Hire, the Hirer must notify JUCY as soon as practicable, and in any event within 48 hours, from the time the Hirer has knowledge of the defect or failure to give JUCY the opportunity to rectify the problem during the Term of Hire. JUCY does not accept liability for any claims submitted after this period. h) The Hirer must ensure that a copy of this Agreement is kept in the Vehicle throughout the Term of Hire and produced without delay for inspection on demand by an enforcement officer i) The Hirer shall not: i) drive or use the Vehicle (or permit the Vehicle to be driven or used) otherwise than in a prudent and cautious manner. Subject to the terms and conditions of this Agreement, the Hirer agrees to pay any additional fees and costs that are incurred by the Hirer or are payable by JUCY in connection with the hire of the Vehicle by the Hirer including parking charges and fines, toll road charges and fines, camping charges and fines, speeding and other traffic offence fines, late return fees, relocation fees, and cleaning fees. In addition, the Hirer authorises JUCY to debit the Hirer’s credit card for those additional costs which become apparent following the Term of Hire. B. The Hirer must pay for all petrol or diesel (but not oil) used in the Vehicle during the Term of Hire, except where the Hirer has paid a pre- purchased fuel option. C. The following credit cards or debit cards will be accepted: Visa, MasterCard, Union Pay D. Some banks and credit card providers may impose fees for certain transactions, including currency conversion fees. Any fees and other charges which may be charged to the Hirer or the Hirer’s bank or credit card provider will be the Hirer’s sole responsibility, and for the avoidance of doubt, are not included in any rate or sum provided by JUCY. E. The Hirer accepts the risk of any currency exchange rate fluctuations (including in relation to refunds and return of Bonds) and accepts that JUCY has no control over any currency conversion rates or fees. F. If a credit card is presented as payment, the credit card holder is jointly and severally liable as a Hirer. The Hirer agrees that: C. Subject to clause 8(e), the Hirer agrees to release and indemnify JUCY from and against all actions, claims, demands, losses, damages, costs, expenses, harm or other misadventure which the Hirer may suffer or incur or become liable for as a result of any use of the Vehicle in breach of this Agreement, any reckless or negligent act, error D. Notwithstanding any provision in this Agreement to the contrary, the Hirer is not liable to JUCY for any loss to the extent that it is caused by us (for example, through our negligence or breach of contract). JUCY ACR does not accept liability for any claims submitted after this period. hi) The Hirer must ensure that a copy of this Agreement is kept in the Vehicle throughout the Term of Hire and produced without delay for inspection on demand by an enforcement officer. ij) It is the Hirer’s responsibility to be aware of and act in compliance with all the Australian Transport Agency rules and regulations. k) The Hirer shall not use or permit the Vehicle to be used for the transport of passengers for hire or reward, this includes but is not limited to use or permit of the Vehicle for purposes as a taxi, uber or for car sharing. l) The Hirer shall not: (i) drive or use the Vehicle (or permit the Vehicle to be driven or used) otherwise than in a prudent and cautious manner. For the purposes of these terms and conditions, a single Vehicle vehicle rollover shall be considered a breach of this clause 6(i6(l)(i); (ii) unless Permit the Stress Free Plus excess reduction has been taken outVehicle to be operated outside the Hirers authority; (iii) Operate the Vehicle, or allow it to be operated, in circumstances that constitute an offence against any relevant Australian or Queensland motor vehicle or traffic act or regulation (iv) Operate the Vehicle, or permit it to be operated in any race, speed test, rally or contest; (v) Operate the Vehicle or permit it to be operated for the transport of more than the number of passengers or more than the gross vehicle mass specified in the certificate of loading for the Vehicle; (vi) Drive or permit the Vehicle to be driven by any other person that is not the holder of a current driver’s licence appropriate for the Vehicle; or (vii) Use the Vehicle for the purpose of a courier or delivery service. n) The Hirer must ensure that no persons interfere with the odometer or speedometer, or (except in an emergency) any part of the engine, transmission, and braking and/or suspension systems of the Vehicle. o) The Hirer confirms that all information supplied by them to ACR in connection with this Agreement is true and accurate and the Hirer will immediately notify ACR of any change to the information. p) The primary concern of ACR is the well-being of the Hirer and the occupants of the Vehicle and, for safety purposes, ACR reserves the right, at its sole discretion, to restrict Vehicle movements in certain areas due to adverse road or weather conditions, and the distance to nominated destinations in relation to the length of hire period. ACR will advise you on pick up of any travel restrictions known at that time.

It is strongly recommended by Land Transport New Zealand that children should be seated in the rear of Vehicles. k) It is the Hirer’s responsibility to be aware of and act in compliance with all the New Zealand Transport Agency rules and regulations. l) The Hirer shall not use or permit the Vehicle to be used for the trans- port of passengers for hire or reward, unless the Vehicle is hired with the knowledge of JUCY for use in a passenger service licensed under Part 4A of the Transport Service Licensing Act. m) The Hirer shall not: (i) drive or use the Vehicle (or permit the Vehicle to be driven or used) otherwise than in a prudent and cautious manner. For the purposes of these terms and conditions, a single Vehicle vehicle rollover shall be considered a breach of this clause 6(i6(l)(i); (ii) unless Sublet or hire the Stress Free Plus excess reduction has been Vehicle to any other person; (iii) Permit the Vehicle to be operated outside the Hirers authority; (iv) Operate the Vehicle, or allow it to be operated, in circumstances that constitute an offence against section 56, 57, 57AA, 57A or 58 of the Land Transport Act 1998 (“Act”). The Hirer will return the Vehicle in a clean condition with a full fuel tank and a full bottle this Agreement: take proper care of gas (if applicable, and subject to any pre-purchase fuel and/or pre- purchase gas option being taken), on the Return Date at the time and at the Return Point set out in the Rental Agreement. b) The Hirer must ensure that all reasonable care is taken in handling and parking the Vehicle and that it ensure the Vehicle is left securely used in a lawful and reasonable manner in all respect and in particular (without limitation) will keep the Vehicle locked when not in use. c) The Hirer must use and shall ensure that ignition keys and/or security arming devices are not left in the recommended levels are maintained vehicle unattended; ensure that every driver of the Vehicle carries his or her driver's licence in the Vehicle at all times and will produce it on demand to any police, traffic or other enforcement officer; return the Vehicle to the Owner in the same condition as when received as evidenced by the Hirer’s signature on the Owner’s “Check-in slip” relating to the Vehicle (fair wear and tear only excepted) to the Owner’s address specified overleaf immediately upon demand by the Owner (such demand not to be made without reasonable cause) subject to a refund to the Hirer of any sums already paid by the Hirer in excess of those due under the terms of this Agreement; immediately report any accident, loss or damage involving the Vehicle to Owner and the police or other proper authority and at the Owner’s request complete the Owner’s accident report form without delay; immediately report any breakdown, fault or defect reasonably requiring repair to the Owner and will not in the case of a defect or fault which makes the Vehicle unroadworthy or liable to cause damage or danger to persons or property or further damage to the Vehicle, use the Vehicle until such defect or fault has been repaired or corrected and will take all reasonable steps to prevent or mitigate any loss or damage occurring to the Vehicle; obtain the Owner’s prior written consent before incurring repair costs in excess of Kshs__________________ not remove or interfere with respect any Vehicle parts or spares or with any identification marks or plates affixed to the Vehicle; inform the Owner immediately upon request of the whereabouts of the Vehicle; not sell, mortgage, charge, pledge, assign, underlet, lend or otherwise dispose of or part with possession of the Vehicle at any time or contract so to do or otherwise deal with the Vehicle in any manner inconsistent with the Owner’s rights; ensure that the water in the radiator and battery, oil in the oil vehicle are maintained at the proper level and in accordance with the tyre pressures manufacturer’s recommendations; ensure that the tyres are maintained at their proper pressure and in accordance with the manufacturer’s recommendations; remove all personal items from the Vehicle upon return of the Vehicle. d) Smoking and/or animals (excluding registered guide ; at the Owner’s request assist the Owner in enforcing any rights or assistance dogs) are not permitted remedies the Owner may have against third parties in respect of any loss or damage to or in connection with the Vehicle at any time. If this condition is breached, the Hirer must pay to JUCY a cleaning fee determined by JUCY in its reasonable opinion and being not more than $250. e) The Hirer must ensure that all Authorised Drivers comply with, and all Authorised Drivers shall be bound by, these terms and conditions and all Authorised Drivers must carry their driver’s licence with them when driving the Vehicle. f) In the event of any new damage to the Vehicle, the Hirer must notify JUCY of the full circumstances of the damage as soon as practicable (being not more than 48 hours) from the time the Hirer has knowledge of the damage. g) If there is an equipment defect or mechanical failure of the Vehicle arising during the Term of Hire, the Hirer must notify JUCY as soon as practicable, and in any event within 48 hours, from the time the Hirer has knowledge of the defect or failure to give JUCY the opportunity to rectify the problem during the Term of Hire. JUCY does not accept liability for any claims submitted after this period. h) The Hirer must ensure that a copy term of this Agreement is kept in the Vehicle throughout the Term of Hire and produced without delay for inspection on demand by an enforcement officer i) The Hirer shall not: i) drive or use the Vehicle (or permit the Vehicle to be driven or used) otherwise than in a prudent and cautious manner. For the purposes of these terms and conditions, a single Vehicle rollover shall be considered a breach of this clause 6(i) unless the Stress Free Plus excess reduction has been taken out;Agreement.

If this condition is breached, the Hirer must pay to JUCY a cleaning fee determined by JUCY in its reasonable opinion and being not more than $250. e) The Hirer must ensure that all Authorised Drivers comply with, with and all Authorised Drivers shall be are aware they are bound by, these terms and conditions and all by this Agreement. f) All Authorised Drivers must carry their driver’s licence with them when driving the Vehicle. fg) In the event of any new damage to or accident involving the VehicleVehicle during the Term of Hire, the Hirer must notify JUCY of the full circumstances of the damage as soon as practicable (being not more than 48 24 hours) from the time the Hirer has knowledge of the damage. gh) If there is an equipment defect or mechanical failure of the Vehicle during the Term of Hire, the Hirer must notify JUCY as soon as practicableprac- ticable, and in any event within 48 24 hours, from the time the Hirer has knowledge of the defect or failure so as to give JUCY the opportunity to rectify the problem during the Term of HireHire and ensure the problem does not escalate. JUCY does not accept liability for any claims submitted submit- xxx after this period. hi) The Hirer must ensure that a copy of this Agreement is kept in the Vehicle throughout the Term of Hire and produced without delay for inspection on demand by an enforcement officer. ij) The Child Restraint Law stipulates that children under 7 must be properly restrained in an approved child restraint. It is the Hirer’s responsibility to ensure the child restraint is installed correctly not JUCY’s. It is strongly recommended by Land Transport New Zealand that children should be seated in the rear of Vehicles. k) It is the Hirer’s responsibility to be aware of and act in compliance with all the New Zealand Transport Agency rules and regulations. l) The Hirer shall not use or permit the Vehicle to be used for the trans- port of passengers for hire or reward, unless the Vehicle is hired with the knowledge of JUCY for use in a passenger service licensed under Part 4A of the Transport Service Licensing Act. m) The Hirer shall not: (i) drive or use the Vehicle (or permit the Vehicle to be driven or used) otherwise than in a prudent and cautious manner. For the purposes of these terms and conditions, a single Vehicle vehicle rollover shall be considered a breach of this clause 6(i6(l)(i); (ii) unless Sublet or hire the Stress Free Plus excess reduction has been Vehicle to any other person; (iii) Permit the Vehicle to be operated outside the Hirers authority; (iv) Operate the Vehicle, or allow it to be operated, in circumstances that constitute an offence against section 56, 57, 57AA, 57A or 58 of the Land Transport Act 1998 (“Act”). (v) Operate the Vehicle, or permit it to be operated in any race, speed test, rally or contest; (vi) Operate the Vehicle or permit it to be operated in breach of the Act, Transport Xxx 0000, Land Transport (Road User) Rule 2004 or any other Act, regulations or bylaws including New Zealand Transport Agency rules relating to road traffic; (vii) Operate the Vehicle or permit it to be operated for the transport of more than the number of passengers or more than the gross vehicle mass specified in the certificate of loading for the Vehicle; (viii) Drive or permit the Vehicle to be driven by any other person that is not the holder of a current driver’s licence appropriate for the Vehicle; or (ix) Use the Vehicle for the purpose of a courier or delivery service. n) The Hirer must ensure that no persons interfere with the odometer or speedometer, or (except in an emergency) any part of the engine, transmission, and braking and/or suspension systems of the Vehicle. o) The Hirer confirms that all information supplied by them to JUCY in connection with this Agreement is true and accurate and the Hirer will immediately notify JUCY of any change to the information. p) The primary concern of JUCY is the well-being of the Hirer and the occupants of the Vehicle and, for safety purposes, JUCY reserves the right, at its sole discretion, to restrict Vehicle movements in certain areas due to adverse road or weather conditions, and the distance to nominated destinations in relation to the length of hire period. JUCY will advise you on pick up of any travel restrictions known at that time. q) The Hirer must ensure that snow chains are fitted correctly, so as not to cause damage to the Vehicle, person or property, when required due to the road conditions during the winter season (June-October) or on roads as advised by the relevant local authority, Transit New Zealand, NZ Police or the relevant ski resort. Vehicles driven around the Queen- stown Lakes District Council area or taken out;on the Milford Road during the winter season should carry chains as the Hirer may be fined for not fitting them when required.
