Subscriber’s Obligations. 6.1 The Subscriber agrees that it shall: 6.1.1 immediately notify Faircom on becoming aware of any unauthorised use of all or any of the Services; 6.1.2 promptly reporting any incident or fault in the Services to Faircom; 6.1.3 ensure that it has all necessary consents, permissions, waivers, and licenses to make use of the Services; 6.1.4 be entirely liable for all activities conducted and charges incurred under its passwords and usernames whether authorised by it or not and the Subscriber acknowledges that Faircom shall not be liable for any loss of confidentiality or for any damages arising from the Subscriber's inability to comply with these Conditions; 6.1.5 comply with any security policy notified to it from time to time by Faircom and, in particular, ensure that all passwords and usernames provided to it by Faircom are at all times kept confidential, used properly and not disclosed to unauthorised people. If the Subscriber has any reason to believe that any password or username has become known to someone not authorised to use it or is being or is likely to be used in an unauthorised way or of any other breach of security then the Subscriber will change all such passwords and inform Faircom immediately; 6.1.6 provide to Faircom accurate and up to date contact information, including full legal name, mailing address, telephone number, and e-mail address, and ensure that all such contact information which it provides to Faircom are at all times true, current, accurate and complete. The Subscriber will promptly notify Faircom of any change to such details and acknowledges that Faircom will not be liable for any loss suffered or incurred by the Subscriber as a result of its failure to notify such changes to Faircom; and 6.1.7 promptly provide to Faircom and/or its consultants, employees and agents such information and assistance as they may reasonably require in order to be able to carry out the Services and any other obligations under the Agreement and will appoint a representative who is fully empowered and authorised to provide same; 6.2 The Subscriber agrees that it shall not: 6.2.1 use the Services or allow them to be used for any unlawful purpose or for the publication, linking to, issue or display of any unlawful material (including any pirated software or any material which is obscene, pornographic, threatening, malicious, harmful, abusive, defamatory or which breaches the rights including Intellectual Property Rights of any third party or which i...

The Subscriber is responsible for ensuring that unauthorized personnel do not use the Subscriber’s account. Unauthorized personnel for the purposes of this contract shall be any person, employee, support staff, or entity other than the Subscriber. d. Information accessed from OCRA is for the use of the Subscriber in the ordinary course of their business. e. The Subscriber is responsible for ensuring that the use of OCRA is conducted in a proper and legal manner. If the Subscriber is convicted of a crime, including but not limited to, a violation of the Virginia Computer Crimes Act (Section 18.2-152.1 of the Code of Virginia), arising out of their use of OCRA, the Clerk's Office shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting the Clerk's Office from pursuing any other remedy available to it for such breach. f. The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time Subscriber has knowledge of compromised security of Subscriber’s access credentials, Subscriber will IMMEDIATELY notify the Clerks Office in writing. g. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one username login for one individual Subscriber. h. Information obtained on the website cannot be sold or posted on any other internet website or redistributed to any third party.
Subscriber’s Obligations. Subscriber agrees to the following: 4.1 to be responsible for installation, costs and maintenance of a communactions link and equipment; 4.2 to be responsible for communication costs incurred by any Authorized User connecting to the Product with a valid password; 4.3 to be responsible for the confidentiality and security of the identification password(s) issued to Subscriber by Ovid. If the Subscriber or one of its employees is convicted of a crime, including, but not limited to, a violation of the Virginia Computer Crimes Act (§ 18.2-152.1 of the Code of Virginia), arising out of the use of the system, such conviction shall constitute a material breach of this Agreement, and the Clerk’s office shall have the right to terminate this Agreement immediately. Nothing contained herein shall be construed as prohibiting the Clerk’s office from pursuing any other remedy available to it for such breach.
Subscriber’s Obligations. The Subscriber’s obligations are: • The application details provided by the Subscriber shall be truthful, accurate, and not misleading. Failure by a subscriber to comply, or to promptly correct inaccurate in- formation will result in revocation of the certificate. • Review and verify the Certificate contents for accuracy • The key pair is only used in accordance with the above limitations. • Reasonable care is exercised to avoid unauthorized use of the Subscribers Private Key. • The Subscriber handles a User-ID, Password or PIN, which can be used to access the ATC’s Webservice and which give access to the Private Key. The Subscriber shall treat this information – including the Private Key itself - as confidential and keep it secret. • The Subscriber shall notify the ATC, without any unreasonable delay, if o any of the above described violations occur up to the end of the validity period indicated in the Certificate, or o the Subscribers Private Key – or the control over it - has been potentially or actually lost, stolen or compromised, or o certificate(s) issued to him by the ATC became compromised. o it is discovered that Code submitted to the Signing Service for Code Signature contained Suspect Code. • If the Subscriber Certificate is use for a high-traffic FQDN, the Subscriber has to “sta- ple” the OCSP response for the Certificate in its TLS handshake, see RFC4366 • The Subscriber shall promptly cease all use of the Private Key corresponding to the Public Key included in the Certificate upon expiration or revocation of the Certificate. • The Subscriber uses the Certificate and associated Private Key only for authorized and legal purposes, including not using the Certificate to sign Suspect Code and to use the Certificate and Private Key solely in compliance with all applicable laws and solely in accordance with the Subscriber Agreement or Terms of Use. If subscriber and certificate owner are different persons or subjects, the subscriber has to inform the certificates owner about his duties.

Subscriber’s Obligations. 3.1 Compliance with Laws and Rules and Regulations. Subscriber agrees that Subscriber will comply at all times with all applicable laws and regulations and Netgateway's general rules and regulations relating to its provision of eCommerce Services, currently included herein as Section 10, which may be updated and provided by Netgateway to Subscriber from time to time ("Rules and Regulations"). Subscriber acknowledges that Netgateway exercises no control whatsoever over the content contained in or passing through the Subscriber's web site, storefront or mall ("ECommerce Centers"), and that it is the sole responsibility of Subscriber to ensure that the information it transmits and receives complies with all applicable laws and regulations.
Subscriber’s Obligations. SUBSCRIBER is responsible for ensuring that only authorized users access the CLERK'S FTP site. Authorized Users for the purposes of this Agreement shall be any person or entity provided as a SUBSCRIBER'S Authorized User listed in Exhibit "A", or any person thereafter substituted for the Authorized User. SUBSCRIBER shall amend the Authorized User by submitting amendments in writing to CLERK. CLERK will revoke and issue User login id and password upon receipt of SUBSCRIBER'S request to amend Authorized User. SUBSCRIBER is responsible for ensuring that access to the CLERK'S FTP site and use of the data obtained from the CLERK by any of its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER or any of its Authorized Users is charged with a crime arising from that access to the CLERK's FTP site or of use of data obtained from the CLERK, the CLERK shall have the right to terminate this Agreement immediately, and the SUBSCRIBER shall be solely liable for any and all illegal actions relating to the misuse of CLERK provided data. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such a breach. SUBSCRIBER is responsible for immediately purging all data related to records that are subsequently records deemed confidential by Florida Statutes, federal statutes, Florida Rules of Court, or orders/opinions from courts in Florida. This must be accomplished by processing a file located on the FTP server that will contain all such records. See Exhibit “C” for additional information. SUBSCRIBER shall upon execution of this agreement make payments as detailed in Exhibit “B”. Public information is provided subject to the laws of the State of Florida.

This shall not be constructed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER or one of its Authorized Users is charged with a crime arising out of use of the subscriber site, the CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such a breach. THE PUBLIC INFORMATION IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDA. SUBSCRIBER is responsible for pre-payment of the subscription fees in order to maintain active account status. The CLERK will invoice SUBSCRIBER prior to the subscription period end date for renewal. Payments must be received within 30 days of the due date or the SUBSCRIBER account will be terminated.
