Common use of HITECH Act Clause in Contracts

HITECH Act. “HITECH Act” shall mean subtitle D of the Health Information Technology for Economic and Clinical Health Act provisions of the American Recovery and Reinvestment Act of 2009, 42 U.S.C. Sections 17921-17954, and all its implementing regulations, when and as each as effective and compliance is required.

HITECH Act. “HITECH Act” shall mean subtitle D of the Health Information Technology for Economic and Clinical Health Act provisions Act, enacted as Title XIII of Division A and Title IV of Division B of the American Recovery and Reinvestment Act of 2009, 42 U.S.C. Sections 17921P.L. 111-179545. All references in this Agreement to such Act or to any section thereof shall be deemed to include all applicable regulations and guidance as may be promulgated or issued, and all its implementing regulationsrespectively, when and as each as effective and compliance is requiredto implement such Act.
