Common use of Holidays and workers compensation Clause in Contracts

Holidays and workers compensation. An employee absent as the result of an accident sustained in the course of his/her employment or in the periodic journeying to or from his/her place of employment and who is receiving payment under any Workers' Compensation Act shall not be entitled to payment for any holidays prescribed in subclause 42.1. occurring during such absence, but shall only be entitled to the difference between the payment received for such day under any Workers' Compensation Act and their normal wage for the holiday.
