Housing Loan by Allottee. In case the Allottee, with the prior consent in writing of the Promoter, obtains any housing loan or finance to pay the consideration envisaged herein, the same shall be subject to the terms and conditions of this Agreement and the entire obligation or liability in respect of the same shall be that of the Allottee alone. The bank/financial institution providing housing loan or finance to the Allottee shall be required to disburse/pay all amounts due and payable to the Promoter under this Agreement and in no event shall the Promoter assume any liability and/or responsibility for any loan and/or financial assistance which may be obtained by the Allottee from such bank/ financial institution. Any consent given by the Promoter in respect of any such housing loan or finance shall not affect the obligations and liabilities of the Allottee hereunder nor the rights and authorities of the Promoter including to cancel or terminate this agreement owing to any delay or default of the Allottee and upon forfeiture of stipulated amounts and adjustment of its dues to pay the balance to the financer of the Allottee in due discharge of the Designated Apartment.

The eligibility and disbursement of any subsidy is solely at the discretion of the Nodal Agency appointed by Government of India for the same and the Promoter shall have no responsibility, liability or accountability, inter alia, in connection with the sanction and disbursement of such benefit. Housing Loan by Allottee. In case the Allottee is desirous of obtaining any housing loan or finance or availing the benefits under any subsidy scheme of the Bank or Financial Institution or the Government for payment of the consideration envisaged herein, he/she shall be at liberty to choose any Bank or financial Institution to get the same. However, the same shall be subject to the terms and conditions of this agreement and the entire obligation or liability in respect of the same shall be that of the Allottee or Bank or Financial Institution whom the Allottee has approached for availing such any housing loan or finance or the benefits or subsidy scheme and the Promoter or its directors, men agent and staff shall not have any liability or responsibility in this regard. The Promoter or the Owner or any of their agent or representative have neither referred the Allottee to any Bank nor they have represented or assured the allottee about the grant of any such loan or finance or subsidy to the allottee and they shall not be held responsible in any manner if any loan or finance or subsidy is not granted or disbursed to the allottee. The eligibility and disbursement of any loan or finance or subsidy is solely at the discretion of the concerned bank/financial Institution or Nodal Agency appointed by Government of India for the same and the Promoter shall have no responsibility, liability or accountability, inter alia, in connection with the sanction and disbursement of such loan/finance or the benefit of the any subsidy. The bank/financial institution providing housing loan or finance to the Allottee shall be required to disburse/pay all amounts due and payable to the Promoter under this Agreement and in no event the Promoter shall assume any liability and/or responsibility for any loan and/or financial assistance which may be obtained by the Allottee from such bank/ financial institution.

  • Cancellation by Allottee The Allottee shall have the right to cancel/withdraw his allotment in the Project as provided in the Act: Provided that where the allottee proposes to cancel/withdraw from the project without any fault of the promoter, the promoter herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the allottee shall be returned by the promoter to the allottee within 45 days of such cancellation.

  • PROVISIONS OF THIS AGREEMENT APPLICABLE ALLOTTEE/ SUBSEQUENT ALLOTTEES It is clearly understood and so agreed by and between the Parties hereto that all the provisions contained herein and the obligations arising hereunder in respect of the said Apartment/ Plot and the Project shall equally be applicable to and enforceable against and by any subsequent Allottee of the Apartment/ Plot, in case of a transfer, as the said obligations go along with the Apartment/ Plot for all intents and purposes.
