How the Fixed Voice Service is supplied. 1.1. Developments in Network technology known as Local Loop Unbundling or “LLU”, and the development of our own network or use of a preferred network (the “Fluent Network”) and hosted voice telephony product (“Fluent IP Telephony”), which operates on the Fluent Network, may enable us to provide you with fixed voice telephony services through the use of LLU and/or the Fluent Network instead of or in addition to analogue or standard ISDN telephony. 1.2. Where we supply you with the Fixed Voice Service, you agree that we may determine which of the methods referred to in Part B paragraph 1.1 will be used to supply you with the ability to make Calls, including in circumstances where you were receiving broadband services from another provider on the same Line at the time of transfer to us. Where we supply you with the Fixed Voice Service using the Fluent Network or Fluent IP Telephony, you will be subject to Part C (Connectivity Service Specific Terms) in addition to this Part B (Fixed Voice Service Specific Terms). 1.3. Where we provide you with a Line, no other service provider may route Calls in respect of those Lines that we supply to you, and if they do then we reserve the right to bar such Calls. 1.4. On the day that a transfer pursuant to Part B paragraph 1.2 occurs, you may experience a short temporary loss of service of up to one working day. Thereafter, you may also have to re-set your access numbers and/or passwords. On completion of a transfer to LLU or the Fluent Network, you acknowledge and agree that: 1.4.1. certain telecommunications services purchased from or provided by other telephone providers, such as, but not limited to, indirect access services (whether using the BT 1280 or other indirect access codes) may no longer be available; and 1.4.2. you will no longer be able to use broadband or line rental services from other providers (and we will not be liable for any charges which may arise as a result of the termination of your contract with other providers of those services).

  • Unbundled Voice Loop SL2 (UVL-SL2) loops may be 2-wire or 4-wire circuits, shall have remote access test points, and will be designed with a DLR provided to NuVox. SL2 circuits can be provisioned with loop start, ground start or reverse battery signaling. OC is provided as a standard feature on SL2 loops. The OC feature will allow NuVox to coordinate the installation of the loop with the disconnect of an existing customer‟s service and/or number portability service. In these cases, AT&T will perform the order conversion with standard order coordination at AT&T‟s discretion during normal work hours.

  • DISTRIBUTION OF CONTRACTOR PRICE LIST AND CONTRACT APPENDICES Contractor shall provide Authorized Users with electronic copies of the Contract, including price lists and Appendices, upon request. Contract Updates will be handled as provided in Appendix C – Contract Modification Procedures.

  • Supply of Services 7.1 Supplier shall provide the Services to Purchaser in accordance with the Order in all material respects using reasonable care and skill. 7.2 Supplier shall use reasonable endeavours to meet any performance dates for the Services specified in the Order but any dates shall be estimates only and time shall not be of the essence for the performance of the Services. 7.3 Supplier shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirements or which do not materially affect the nature or quality of the Services. 7.4 Purchaser shall: (a) ensure that the terms of Order are complete and (if submitted by Purchaser) the service specification are complete and accurate; (b) co-operate with Supplier in all matters relating to the Services; (c) provide Supplier, its employees, agents, consultants and subcontractors with access to Purchaser’s premises, machinery and other facilities as reasonably required by Supplier to provide the Services; and (d) provide Supplier with such information and materials as Supplier may reasonably require to supply the Services, and ensure that such information is accurate in all material respects. 7.5 If Supplier’s performance of any of its obligations in respect of the Services is prevented or delayed by an any act or omission by Purchaser or failure by Purchaser to performs its obligations (“Purchaser Default”) Supplier shall without limiting its other rights or remedies have the right to suspend performance of the Services until Purchaser remedied Purchaser Default and relieves Supplier from its obligations to the extent the Customer Default prevents or delays Supplier’s performance. Purchaser shall indemnify Supplier against all liabilities costs, losses and expenses which Supplier may incur by reason of Purchaser Default. 7.6 Where the Services consist of any experimental or developmental work, the results supplied or recommendations made under the Services are given in good faith within the limitations of the data available, but no warranty, expressed or implied, is given as to the ability of Supplier to achieve a specific outcome, nor the accuracy of results obtained. 7.7 Any claims by Purchaser which is based on defect in the Services shall be notified to Supplier within twenty-one (21) days of the services being performed and promptly after discovery of defect or failure. The sole and exclusive remedy of Purchaser for such defect hereunder shall be the re-performance or re- fund, at Supplier’s option, of any defective or non-conforming Services.

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • Autism Services This plan covers the following services for the treatment of autism spectrum disorders. • Applied behavior analysis when provided and/or supervised by an individual licensed by the state in which the service is rendered. See the Summary of Medical Benefits for the amount that you pay. • Physical therapy, occupational therapy, and speech therapy services when rendered as part of the treatment of autism spectrum disorder. A benefit limit will not apply to these services. • Psychological and psychiatric services, and prescription drugs are also covered. See Behavioral Health Services and Prescription Drugs and Diabetic Equipment or Supplies for additional information. Coverage for autism spectrum disorders does not affect any obligation of a school district, a state or other governmental entity to provide services to an individual under an individualized family service plan, an individualized education program, or similar services required under state or federal law. Services related to autism that are furnished by school personnel are not covered under this plan.
