APPLETON reserves the right to change or discontinue any of its products. If the products covered by the warranty are not available at the time the claim is made, APPLETON shall have the right to substitute a product that is of equal quality or value. A color variance may occur between the replacement product and the original product as a result of weathering and is not a material defect. APPLETON also has the option of refunding the owner's original purchase price of the product and cost of installation, if any. IF YOU PURCHASED REPLACEMENT WINDOWS: Condensation on any window or patio door is the natural result of excessive moisture in the house and does not indicate a defective product or faulty installation. Nu Look is not responsible for condensation and this Warranty does not apply to condensation, its causes or its effects. Additionally, reinstallation of window sashes due to mishandling will be subject to labor charges set forth above. IF YOU PURCHASED GUTTERS: New gutters will not prevent ice damming or icicles. Leaf protection alleviates leaves and debris inside the gutters. However, Customer may need to clean leaves and debris resting on top of the gutter system. Leaf protection does not prevent against ice dams & icicles. IF YOU PURCHASED SHINGLES: Installation of snow and ice shield does not prevent ice damming. A wavy area or raised appearances may be present in your shingles for up to six (6) months after the end roof is installed. Drywall repairs due to roof leaks will be covered for a period of the lifetime of the original installation on the structure on which the products are originally installed shall six (6) months after installation. IF YOU PURCHASED SIDING: Customer needs to be aware that siding can be damaged by heat from grills and that any such damage will not be covered by this warranty. WHAT WE WILL DO. All warranty work warranties terminate immediately upon the transfer of home ownership, other than in accordance with the transferability directions described herein. All warranties assume normal and reasonable use of XXXXXXX CONSTRUCTION-installed products or components. Minor color or textural variations from lot-to-lot of product are not product or installation defects. These warranties do not cover any other damage, workmanship, or material failure beyond the control of XXXXXXX CONSTRUCTION including, but not limited to, damage caused by occurrences, such as settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, removal, repair, or re-installation of any XXXXXXX CONSTRUCTION-installed products or components by other than XXXXXXX CONSTRUCTION, normal weathering, corrosive effects of salt air and chemical pollutants, normal fading, deterioration of caulking compounds, fire, flood, lightening, high winds, windblown objects, earthquake, hurricanes, ice dams, icicles and/or ice storms, atmospheric conditions, or weather of catastrophic nature as defined by the US Weather Bureau, other acts of God, intentional acts, unreasonable use, vandalism or pollution. These warranties also will commence not apply to damages resulting from the failure to provide reasonable maintenance, including failure to clean the product or maintain sealing, painting and/or caulking as reasonably necessary. XXXXXXX CONSTRUCTION is also not responsible for existing or developing spore or mold growth. Mold and mildew may be due to condensation, which may form on or within walls or other surfaces resulting from pre-existing conditions in the Owner’s home. What Voids These Warranties: Installation, removal, repair, adjustment, tampering or re-installation of any XXXXXXX CONSTRUCTION products or components by APPLETON other than XXXXXXX CONSTRUCTION voids any and warranties within this document, and XXXXXXX CONSTRUCTION expressly disclaims any liability for any costs, defects, or its agents within six (6) months of receipt of a written claim. This warranty does not cover any other damage, workmanship, or material failure including, but not limited to, damage caused by occurrences beyond the control of MGP, such as settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, installation-related damage, normal weathering, corrosive effects of salt air and chemical pollutants, excessive wear, scouring due to cleaning, normal fading, deterioration of caulking compounds, fire, flood, lightning, high winds, windblown objects, earthquakes, hurricanes, ice dams, icicles and/or ice storms, hail, atmospheric conditions or weather of catastrophic nature as defined by the U.S. National Weather Service, other acts of God, intentional acts, unreasonable use, vandalism, harmful chemicals (including harmful cleaning compounds and pesticides), pollution, airborne stains, xxxx, mold, mildew, or algae; warping or distortion due to exposure to excessive heat sources; any blockage or obstruction that is determined to be below grade; or misalignment caused by foliage, tree limbs or ladders placed against the Product or component thereof. This warranty does not apply to damages due to or arising from the identification, detection, abatement, encapsulation, or removal of mold, asbestos, lead-based products, or other hazardous substances inside or outside of the structure being improved. This Warranty will not apply to damages resulting from the failure to provide reasonable maintenance. This Warranty shall not apply to (a) installation of the Product on gutters hung with straps, on roofs with rubber membranes or on wood shake roofs that have been sealed subsequent to installation, (b) water runoff or overshooting, which may be caused by long or steep valleys or roof designs that cause high volumes of water to be concentrated on a small section of the Product, (c) water dripping off the front drip edge or end caps, (d) the formation of icicles or the accumulation of snow and/or ice, (e) installations where gutters that are unprotected by the Product are tied into gutters protected by the Product, (f) where water will be filtered twice, (g) metal roofs that lack adequate snow guards, (h) any underground drain, (i) accumulation on the exposed surface of the Product of silt or of debris resulting from the severe deterioration of roof shingles, and/or (j) any leaves, debris, or discarded foliage sitting on the hood of the Product. MGP makes no representation regarding the elimination or prevention of ice formation with the installation of the Product. It is normal to see icicles on the outside of the Product. This condition can be severe where there is excessive heat loss from the roof. Please examine Your roof and xxxxx on a regular basis in cold weather and safely clear off any dangerous or overhanging icicles. In certain regions where xxxx, lichen, tree sap, or pine resin are prevalent in excessive amounts, or are often seen on your roof, the exposed surface of the Product may require periodic maintenance to prevent organic build-up and minor runoff. New roofs, or roof shingles that have been cut, broken, ripped, or torn may cause roof tar to leak onto the Product. In such cases the exposed surface of the Product may require spot cleaning to eliminate any tar buildup. Direct contact of aluminum portions of the Product with certain dissimilar materials, or with water run-off from dissimilar materials, may result in corrosion to the Product. Care should be taken to avoid contact between the Product’s aluminum and dissimilar materials including dissimilar metals, concrete, stucco, asbestos siding, pressure-treated/pretreated lumber, roofing materials, or roofing systems containing metallic granules or strips, or corrosive non-metallic materials. Any claim notification received by APPLETON after the end of the lifetime of the original installation on the structure on which the products are originally installed Product damage or defect resulting from contact with dissimilar materials shall not be covered by this warranty. APPLETON will assume 100 percent of the cost of material and labor for repair, replacement or refinishing, at its option, for claims made during the first two (2) years of the warranty period. Within a reasonable time after receiving the warranty claim notice, APPLETON will notify the owner whether the claim has been accepted and, if so, how it intends to remedy the defect under this warranty. Any claim notification received by APPLETON after the end of the lifetime of the original installation on the structure on which the products are originally installed shall not be covered by this warranty. WHAT WE WILL DO. APPLETON will assume 100 percent of the cost of material and labor for repair, replacement or refinishing, at its option, for claims made during the first two (2) years of the warranty period. Thereafter APPLETON you will be responsible for the cost set forth above based on when a claim is made on the following prorated basis, all return-shipping and the owner shall be responsible for the difference: 90 percent during the third year, 5 percent less than the preceding year for each succeeding year through the eighteenth year, and thereafter APPLETON will pay 10 percent through the end of the warranty period. APPLETON reserves the right to change or discontinue any of its products. If the products covered by the warranty are not available at the time the claim is made, APPLETON shall have the right to substitute a product that is of equal quality or value. The original warranty periods shall not be extended by any warranty claim. A color variance may occur between the replacement product and the original product as a result of weathering and is not a material defect. APPLETON also has the option of refunding the owner's original purchase price of the product and cost of installation, if any. All warranty work will commence by APPLETON or its agents within six (6) months of receipt of a written claim. LIMITATION OF IMPLIED WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE LENGTH OF THIS WARRANTY. EXCLUSION OF CERTAIN DAMAGES. APPLETON'S LIABILITY IS LIMITED TO THAT SET FORTH ABOVE AND SHALL NOT INCLUDE INCIDENTAL OR CONSEQUENTIAL COMMERCIAL DAMAGE OF ANY KIND. EXCLUSIVE REMEDY. THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY OFFERED TO THE OWNER, AND NO OTHER WARRANTIES OF ANY NATURE WHATSOEVER WHETHER EXPRESS OR IMPLIED SHALL APPLY TO THE PRODUCT WHICH IS THE SUBJECT OF THIS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOUother transportation expenses.
