Human Rights - Article. 8: The Right to Respect for Private and Family Life, Home and Correspondence There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others. The benefits of an effective sharing of information for the purposes set out in this agreement are to the direct benefit of the citizen and so in the public interest. This agreement is: In pursuit of a legitimate aimThe promotion of the welfare and wellbeing of Adults at Risk through this agreement for objectives compatible with the Crime and Disorder Xxx 0000 and other similar legislation is a legitimate aim. Proportionate – The amount and type of information shared will be compliant with the Data Protection Xxx 0000 and the minimum necessary to achieve the aims of this agreement, to provide a better service to Adults at Risk. Partner Organisations understand the ‘Public Interest’ criteria to include: • When there is evidence or reasonable cause to believe that an adult is suffering, or is at risk of suffering, serious harm. • To prevent the adult from harming someone else, • The promotion of welfare of the adult; • Detecting crime; • Apprehending offenders; • Maintaining public safety; • and administration of justice. When considering whether disclosure is in the public interest, the rights and interests of the individual must be taken into account. A fair balance between the public interest and the rights of the individual must be ensured.
