Common use of iGrafx’s Responsibilities Clause in Contracts

iGrafx’s Responsibilities. iGrafx will: (i) use commercially reasonable efforts to make the Cloud Services available 24 hours a day, 7 days a week, except for: (a) planned downtime (of which iGrafx shall give at least 8 hours’ notice and which iGrafx shall schedule to the extent practicable during the weekend hours from 6:00 p.m. Friday to 3:00 a.m. Monday Pacific Time), or (b) any Force Majeure event, (ii) provide the Cloud Services in accordance with applicable laws and government regulations; and

iGrafx’s Responsibilities. iGrafx will: (i) use commercially reasonable efforts to make the Cloud Services available 24 hours a day, 7 days a weekweek with an uptime of 99.95%, except for: (a) planned downtime (of which iGrafx shall give at least 8 hours’ notice and which iGrafx shall schedule to the extent practicable during the weekend hours from after 6:00 p.m. Friday to 3:00 a.m. Monday Pacific Time)Customer’s local time, or (b) any Force Majeure event, (ii) provide the Cloud Services in accordance with applicable laws and government regulations; and,
