By signature hereon, Contractor certifies that no member of the Board of Regents of The University of Texas System, the Owner, or Executive Officers, including component institutions, has a financial interest, directly or indirectly, in the transaction that is the subject of this contract.

Contractor represents and warrants that neither Contractor nor any firm, corporation, partnership, or institution represented by Contractor, or anyone acting for such firm, corporation or institution has (1) violated the antitrust laws of the State of Texas under Tex. Bus. & Com. Code, Chapter 15, or the federal antitrust laws; or (2) communicated directly or indirectly the Proposal to any competitor or any other person engaged in such line of business during the procurement process for this contract. Ethics Matters/No Financial Interest. Contractor and its employees, agents, representatives and subcontractors have read and understand TSTC’s Conflicts of Interest Policy available at xxxx://xxx.xxxx.xxx/users/cop/COP2.48-12-10-07.pdf and xxxx://xxx.xxxxxx.xxxx.xxx/governance/sos/hr/HR_2_1_12.pdf, and applicable state ethics laws and rules available at xxxx://xxx.xxxxxxxx.xxx/ogc/ethics/statelaws.htm. Neither Contractor nor its employees, agents, representatives or subcontractors will assist or cause TSTC employees to violate TSTC’s Conflicts of Interest Policy or applicable state ethics laws or rules. Contractor represents and warrants that no member of the Board has a direct or indirect financial interest in the transaction that is the subject of this Agreement.
Illegal Dumping. 3.11.1 As directed by the COUNTY, the FRANCHISEE shall clean up illegal dumping locations on the County Right of Way (ROW). There will be no limitations as to the size or condition of the illegal dump. The illegal dump location will be provided on a work order form provided by the COUNTY and will list the illegal dump address and approximate quantity in cubic yards. FRANCHISEE will be required to collect all illegal dumps issued by the COUNTY within 48 hours of receipt. Any collection vehicle used for illegal dump collections shall not be used for any other service until the materials from the illegal dumps have been disposed at a designated facility. The FRANCHISEE will not comingle any other materials with illegal dump collected materials. The County will reimburse the FRANCHISEE on a per ton basis for the illegal dump collected materials as outlined in Exhibit “B”. No hazardous waste or other prohibited materials are required to be collected as part of this service. Should prohibited materials be identified, the FRANCHISEE will immediately notify the COUNTY.

Subsequent to the issuance of a signed Notice to Proceed, Owner will issue a Purchase Order Revision reflecting the changes in scope, additional services, amendments, modifications, deletions or other changes to the Agreement. Illegal Dumping. No person shall dump or otherwise deposit outside an authorized landfill, convenience center or other authorized garbage or trash collection point, any trash or garbage of any kind or description on any private or public property, occupied or unoccupied, inside the Town.

Illegal Dumping. Service Providers who are found illegally dumping material or leaving material on site will be fined as per the spot fine schedule contained in section 22 of the Special Conditions of Contract, current City of Cape Town By-Laws and/or National Legislation. If it is the County’s intent to have us provide all of the illegal dumping cleaned up, are there limits? Will we be required to go onto private property? To what extent will the illegal dumping need to be cleaned up? We would prefer that we only be required to pick up from the right of way or on County Roads. Additionally, would the county consider a limit on this requirement? We need to understand the Intent of this section. If the pickups are limited to what can be service with a clam truck from the right of way we will price accordingly, if it requires going onto private property or picking up material that will require larger equipment we will price accordingly as well.
Illegal Dumping. At Cities direction, Xxxxxxxxxx agrees to provide targeted clean-up of illegal dumping up to twenty (20) tons annually.
