Incomplete Works. In the event the Contractor fails to complete the Works in accordance with the Project Completion Schedule, including any Time Extension granted under this Agreement, the Contractor shall endeavour to complete the balance work expeditiously and shall pay Damages to the Authority in accordance with the provisions of Clause 10.3 (ii) for delay of each day until the Works are completed in accordance with the provisions of this Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.
Incomplete Works. In the event the Contractor fails to complete the Works in accordance with the Project NH-202 for Package-I (Design Chainage 283+000 Km to 325+440 Km) in the State of Nagaland on EPC mode under NH (O)-NE” JAN 2022 Completion Schedule, including any Time Extension granted under this Agreement, the Contractor shall endeavour to complete the balance work expeditiously and shall pay Damages to the Authority in accordance with the provisions of Clause 10.3 (ii) for delay of each day until the Works are completed in accordance with the provisions of this Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.

II - Improvement to 2 lane with paved shoulder of NH-40 section from Km 93+490 to Km 123+800 (design Km 10+670 to Km 37+550) design length 26.55 km in the State of Meghalaya on EPC Mode under JICA Loan Assistance this Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.
Incomplete Works. 10.5.1 In the event the Contractor fails to complete the Works in accordance with the Project Commissioning Schedule, including any Time Extension granted under this Contract Agreement, the Contractor shall endeavour to complete the balance work expeditiously and shall pay Damages to the Authority in accordance with the provisions of Clause 10.3.2 for delay of each day until the Works are completed in accordance with the provisions of this Contract Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Contract Agreement to take appropriate action against the Contractor including the right to termination under Clause 21.1. 11 QUALITY ASSURANCE, MONITORING AND SUPERVISION
Incomplete Works. In the event the Concessionaire fails to complete the Works in accordance with the Project Completion Schedule, including any Time Extension granted under this Agreement, the Concessionaire shall endeavour to complete the balance work expeditiously and shall pay Damages to the Authority in accordance with the provisions of Clause 11.3.2 for delay of each day until the Works are completed in accordance with the provisions of this Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 24.1.
Incomplete Works. In the event that the Project is not completed and COD does not occur within 270 ( two hundred and seventy) days from the Scheduled Completion Date, unless the delay is on account of reasons attributable to the Authority of due to Force Majeure, the Authority shall be entitled to terminate this Agreement.

In the event the Contractor fails to complete the Works in accordance with the Project Completion Schedule, including any Time Extension granted under this Agreement, Improvement and widening to two lane with paved shoulder of road from Km 63.700 to Km 75.700 (Total length: 12.000 km) i.e. Bamanchara - Srirampur section of NH- 208 (Package-IV) in the state of Tripura on EPC basis July 2020 the Contractor shall endeavour to complete the balance work expeditiously and shall pay Damages to the Authority in accordance with the provisions of Clause 10.3 (ii) for delay of each day until the Works are completed in accordance with the provisions of this Agreement. Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.

Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.

Recovery of Damages under this Clause shall be without prejudice to the rights of the Authority under this Agreement including the right to termination under Clause 23.1.
