INCORPORATION BY REFERENCE OF PROPOSED REGULATIONS. If elected here [ ], notwithstanding any other provision in the Adoption Agreement or the Plan document to the contrary, with respect to distributions under the Plan made for calendar years beginning on or after __________________________ (select January 1, 2001, a date during 2001 in a manner consistent with Announcement 2001-82 or subsequent guidance, or January 1 of any subsequent calendar year prior to the issuance of subsequent guidance or final regulations), the Plan shall apply the minimum distribution requirements of Code Section 401(a)(9) in accordance with the regulations under Code Section 401(a)(9) that were proposed on January 17, 2001. The election made by the foregoing sentence shall continue in effect until the end of the last calendar year beginning before the effective date of final regulations under Code Section 401(a)(9) or such other date as may be specified in subsequent guidance published by the Internal Revenue Service.
