Except as set forth in Section X.E.1.dX.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS Envision has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.below.‌

Independence from Material Breach Determination. Except as set forth in Section X.E.1.dX.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS EGS has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Independence from Material Breach Determination. Except as set forth in Section X.E.1.dX.D.1.d, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS Merit has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Except as set forth in Section X.E.1.dX.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS OCOM has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Except as set forth in Section X.E.1.dX.D.1.d, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS Xxxxxx has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Independence from Material Breach Determination. Except as set forth in Section X.E.1.dX.D.1.d, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS United Therapeutics has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Independence from Material Breach Determination. Except as set forth in Section X.E.1.dX.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS Diversicare has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.

Independence from Material Breach Determination. Except as set forth in Section X.E.1.dX.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that UHS Baptist has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.EX.D, below.
