Independent Expert Report the Independent Expert providing the report to Papillon that concludes that the Scheme is in the best interests of Papillon Shareholders;
Independent Expert Report the Independent Expert providing the report to CGA that concludes that the Scheme is in the best interests of CGA Shareholders;
Independent Expert Report. The Independent Expert provides a report to 92 Energy that concludes that the Scheme is in the best interests of 92 Energy Shareholders and on or before the time when the Scheme Booklet is registered by ASIC under the Corporations Act and the Independent Expert not withdrawing or adversely modifying or qualifying that conclusion before 8.00am on the Second Court Date.
Independent Expert Report. The Independent Expert provides a report to Piedmont that concludes that the Scheme is in the best interests of Piedmont Shareholders on or before the time when the Scheme Booklet is registered by ASIC under the Corporations Act and the Independent Expert not withdrawing or adversely modifying that conclusion before 8:00am on the Second Court Date;
Independent Expert Report. The Independent Expert provides a report to Creso that concludes that the:
(i) Scheme is in the best interests of Creso Shareholders; and
(ii) Option Scheme is in the best interests of Creso Listed Optionholders, on or before the time when the Scheme Booklet is registered by ASIC under the Corporations Act and the Independent Expert not withdrawing or adversely modifying or qualifying that conclusion before 8:00am on the Second Court Date.
Independent Expert Report. No later than forty-five (45) days after the Independent Expert is retained (unless an extension is agreed to in writing by the Parties through the County Administrator and City Manager upon request for additional time by the Independent Expert, which agreement shall not be unreasonably withheld or delayed), the Independent Expert shall consider the P25 Agreement standards, specifications, and requirements (as stated in the P25 Agreement, incorporated as Exhibit B) (the “P25 !greement standards”) together with any further information City or County promptly (as determined by the Independent Expert) provides to the Independent Expert and provide the Parties with a written report that complies with the scope stated in Exhibit A and includes the following:
Independent Expert Report. No later than forty-five (45) days after the Independent Expert is retained, the Independent Expert shall issue and provide the Parties with a written report that complies with the scope stated in Exhibit A and includes the following:
(a) The Independent Expert shall analyze County’s estimates of the total cost of constructing and installing an operational WLP Tower (the “Original Tower Cost”) and of the total annual cost of operating the WLP Tower, including support and maintenance, in accordance with the terms of the P25 Agreement (the “Original Maintenance Cost”) (the Original Tower Cost and the Original Maintenance Cost are collectively referred to as the “Total Original Cost”), together with any further information City or County promptly (as determined by the Independent Expert) provides to the Independent Expert regarding the Total Original Cost, and shall issue an opinion stating the Independent Expert’s estimate of the total cost of constructing and installing an operational WLP Tower (the “Expert’s Tower Cost Estimate”), and of the total annual cost of operating the WLP Tower, including support and maintenance (the “Expert’s Operations Cost Estimate”); and
(b) A comparison, based on the best available information (as determined by the Independent Expert), between (i) the radio coverage and level of service that would reasonably be expected to be provided by a tower at the Circ Site (“Circ Tower”), in accordance with the requirements established by County for the P25 System in the P25 Agreement, and (ii) the radio coverage and level of service that would reasonably be expected to be provided by the WLP Tower, in accordance with the requirements established by County for the P25 System in the P25 Agreement. In conducting this coverage and level of service comparison, the Independent Expert shall consider the expected radio coverage to be provided by the respective towers (once the P25 System is operational) and any additional factors that could affect the service provided by the towers, including, but not limited to, building obstructions, shadowing, water level rise, storm surge, and flooding. The Independent Expert will also include consideration of any service enhancement goods and services (such as, solely by way of example, signal repeaters) if and to the extent that both the Independent Expert determines such enhancements are reasonable and appropriate and City has agreed, in writing, to fund such enhancements if the Circ Site is selected.
Independent Expert Report the Independent Expert provides a report to Incannex that concludes that the Share Scheme is in the best interests of Incannex Shareholders on or before the time when the Scheme Booklet is registered by ASIC under the Corporations Act and the Independent Expert not withdrawing or adversely modifying that conclusion before 8:00am on the Second Court Date; and
Independent Expert Report the Purchaser shall provide such information and otherwise assist any expert appointed by White Energy in any way reasonably requested by the expert to assist in the preparation of its report to accompany the Scheme Booklet.
Independent Expert Report the Independent Expert issues a report which concludes that, in its opinion, the scheme is in the best interests of IOR Shareholders before the date on which the Scheme Booklet is registered with ASIC under the Corporations Act; and
