Should CLEC request indirect interconnection through a non-ILEC tandem switch, the parties will enter into good faith negotiations with such third parties and will amend this Agreement accordingly.
59.7.3 If CLEC has not established 64.8.3 Notwithstanding any other provision to the contrary, once the total volume of Indirect Traffic exchanged between the Parties at a CenturyLink End Office exceeds 200,000 MOU per month, or the one-way traffic from either Party exceeds 100,000 MOU per month, CMRS must establish a POI with or order DTT pursuant to Section 66.2.8 from their POI at a CenturyLink Tandem Switch in the LATA to CenturyLink’s End Office for the mutual exchange of traffic within thirty (30) Days after notification of when the Indirect Traffic exceeds the MOU per month threshold. In situations where CenturyLink’s network contains host and Remote Switches, any traffic from CenturyLink that CLEC has exceeded Remote Switches will be included in the POI Threshold in Sections 59.3.2, CLEC will reimburse CenturyLink for any transit charges billed by an intermediary carrier after MOU determination of the thirty (30) Day period for traffic originated by CenturyLink. CLEC will also reimburse CenturyLink for any transport costs that would be CLEC’s responsibility under from the Direct Interconnection termshost End Office.

64.8.5 If CLEC has not established a POI within thirty sixty (3060) Days after notification from CenturyLink that CLEC has exceeded exceeding the POI Threshold triggers in Sections 59.3.264.8.3 or 64.8.4, CLEC will reimburse CenturyLink for any transit charges billed by an intermediary carrier after the thirty sixty (3060) Day period for traffic originated by CenturyLink. CLEC will also reimburse CenturyLink for any transport costs that would be CLEC’s responsibility under the Direct Interconnection terms.
59.7.4 64.8.6 Each terminating Party is responsible for billing the originating company for traffic terminated on its respective network. Each Party is responsible for the facilities to the Meet Point with the ILEC, and for the appropriate sizing, operation, and maintenance of the transport facility to the Tandem. When CLEC sends traffic to CenturyLink through a third-party ILEC Tandem, CLEC is responsible for all transit charges from the third-party. When CenturyLink sends traffic to CLEC through a third-party ILEC Tandem, CenturyLink is responsible for all transit charges from the third-party ILEC, subject to 64.8.5.
59.7.3 If 64.8.3 When the total volume of traffic exchanged between the Parties at a CenturyLink End Office exceeds a DS1 worth of traffic per month for three consecutive months, or the one-way traffic from either Party exceeds 200,000 MOU per month for three consecutive months, CLEC has not established must establish a POI with CenturyLink’s End Office for the mutual exchange of traffic within thirty (30) Days after notification of when the traffic exceeds the MOU per month threshold. In situations where CenturyLink’s network contains host and remote End Offices, any traffic from CenturyLink that CLEC has exceeded remote End Offices will be included in the POI Threshold in Sections 59.3.2, CLEC will reimburse CenturyLink for any transit charges billed by an intermediary carrier after MOU determination of the thirty (30) Day period for traffic originated by CenturyLink. CLEC will also reimburse CenturyLink for any transport costs that would be CLEC’s responsibility under from the Direct Interconnection termshost End Office.

59.7.2 64.8.2 Indirect Network Connection shall be accomplished by CenturyLink and CLEC CenturyLink Communications LLC,each being responsible for delivering Local Traffic IntraLATA LEC Toll Traffic and VoIP-PSTN Traffic to and receiving such traffic Local Traffic at the ILEC Tandem serving the CenturyLink End Office. Each Party acknowledges that it is the originating Party’s responsibility to enter into transiting arrangements with the third party providing the transit services. Each Party is responsible for the facilities to the Meet Point with the ILEC on the CenturyLink side of the ILEC Tandem, and for the appropriate sizing, operation, and maintenance of the transport facility to the Tandem.
59.7.3 If CLEC has not established 64.8.3 Notwithstanding any other provision to the contrary, once the total volume of Indirect Traffic exchanged between the Parties at an CenturyLink End Office exceeds 200,000 MOU per month, or the one-way traffic from either Party exceeds 100,000 MOU per month, CenturyLink Communications LLC,must establish a POI with CenturyLink’s End Office for the mutual exchange of traffic within thirty (30) Days after notification of when the Indirect Traffic exceeds the MOU per month threshold. In situations where CenturyLink’s network contains host and remote End Offices, any traffic from CenturyLink that CLEC has exceeded remote End Offices will be included in the POI Threshold in Sections 59.3.2, CLEC will reimburse CenturyLink for any transit charges billed by an intermediary carrier after MOU determination of the thirty (30) Day period for traffic originated by CenturyLink. CLEC will also reimburse CenturyLink for any transport costs that would be CLEC’s responsibility under from the Direct Interconnection termshost End Office.
59.7.4 To 64.8.4 Notwithstanding any other provision to the extent a Party combines Local Trafficcontrary, IntraLATA LEC Toll Traffic and Toll VoIP-PSTN Traffic on a single trunk group for indirect delivery through if CenturyLink is assessed transiting costs by a third party ILEC’s Tandemand such charges associated with a single traffic exchange route between the Party and the tandem owner exceed two hundred dollars ($200.00) for one month, CenturyLink Communications LLC,must establish a POI with the originating Party, at CenturyLink End Office serving that route for the terminating Party’s request, will declare quarterly Percentages mutual exchange of Local Use (PLUs). CenturyLink will determine the jurisdiction of a call if CenturyLink has sufficient call details.
a. Such PLUs will be verifiable with either call summary records, call detail samples, or traffic study documentation. The terminating Party should apportion per Minute Of Use (MOU) charges appropriately.within thirty
