Common use of Industrial Accident or Illness (Worker’s Compensation) Clause in Contracts

Industrial Accident or Illness (Worker’s Compensation). 19.5.1 All employees of the District are covered by Worker’s Compensation Insurance for illness or injury arising out of their employment. 19.5.2 Injuries shall be reported as soon as possible to the Human Resources Department on forms provided for this purpose. 19.5.3 Serious accidents or accidents requiring immediate hospitalization should be reported as soon as possible by phone to the Administration Office. 19.5.4 The employee shall continue to receive full regular salary for a period of up to sixty (60) days. If the disability is declared permanent, the employee may apply to STRS for disability retirement. During this sixty (60) day period, any compensation received from the California State Compensation Insurance Fund will revert to the District. 19.5.5 Upon termination of the sixty (60) day industrial accident or illness leave, the employee shall be entitled to the benefits provided under Education Code Sections 44977 (five [5] month differential pay) and 44978 (accumulated sick leave).
