Industrial Rights. 1. The Seller shall be responsible for the fact that the Goods as a whole or their individual components and parts do not violate any industrial or intellectual property rights or other similar rights of third parties. 2. By the Purchase Agreement, no licence to use inventions, patents, industrial designs, utility designs, trademarks, business name, know-how, copyright or other forms of industrial or intellectual ownership is granted and no right to the foregoing is transferred in any manner, with the exception of rights (including licences, etc.) that are needed for the use of the Goods by the Buyer in accordance with the purpose of the Purchase Agreement. 3. If the Goods are manufactured according to the Buyer’s technical documentation provided or otherwise disclosed by the Buyer to the Seller for this purpose the Seller is not entitled to manufacture products (Goods) according to this technical documentation and supply them to any third party. 4. The Seller is not entitled to register or allow registration of any technical solution included in the Buyer’s technical documentation as specified in the foregoing Section, for industrial or copyright protection by a third party. 5. The Seller is obliged to provide written information on use of all of his patents utility and industrial designs on the Goods as well as on the licensed use of patents, utility and industrial designs. Neither his own nor licensed industrial rights or intellectual property rights to the Goods may exclude or limit export of Buyer’s final products. 6. Models, matrices, patterns, specimen, tools or any other production facilities, tools, preparations and equipment provided by the Buyer to the Seller for the purpose of Goods production or paid for by the Buyer cannot be used by the Seller for production to be supplied to third parties.
Industrial Rights. If Seller performs or has performed research, design or development work or activity the cost of which is, either directly or indirectly, included in the price of this purchase order, then any and all inventions and discoveries and information and data generated by Seller in the performance of any work or activity under or related to this purchase order shall be and remain the sole and exclusive property of Buyer. Xxxxxx agrees to disclose such inventions, discoveries, information and data promptly to Buyer and to give all assistance, and to cause its employees to give all assistance necessary to secure full title in such inventions, discoveries, information and data to Buyer. Xxxxxx further agrees to, and to cause its employees to, execute all papers and render such other assistance as is necessary for Buyer to secure, at its expense and option, letters patents covering such inventions and discoveries in countries throughout the world selected by Xxxxx. Xxxxxx further agrees not to use such inventions, discoveries, information and data for any purpose except as directed in writing by Xxxxx and further agrees not to disclose, and to cause its employees not to disclose, same to any person or entity without Xxxxx’s express written consent.

Industrial Rights. 38.1 Federation Representatives - 38.1.1 An accredited Federation representative at the place in which they are employed shall, upon notification thereof to their employer, be recognised as an accredited Federation representative. 38.1.2 An accredited Federation representative shall be allowed the necessary time during working hours to interview the employer or their representative on matters affecting employees. 38.1.3 An accredited Federation representative shall be allowed a reasonable period of time during working hours to interview a duly accredited Federation official. 38.2 Consultative and Other Committee Work - 38.2.1 Where an employee is required by the employer, nominated by the Federation or otherwise selected by other employees to participate in work based consultative or like committees, the employer shall provide such employees with paid leave to attend to such matters. 38.2.2 In addition, where such committees unanimously agree to undertake a particular project consistent with their terms of reference, the employer shall provide sufficient paid time to enable the employee to undertake the project.
Industrial Rights. In its development work, the contractor shall use the care customarily used in its line of business to safeguard the industrial rights of third parties. If the contractor neglects to use the care required by its line of business, it shall be liable for all damaging results which the Deutsche Bundespost Telekom suffers because of the violation of industrial rights by the contractor in its work.

Industrial Rights. 8.1 The Seller undertakes to relieve the Buyer of any claims of third parties in respect of possible infringement of their industrial rights. This provision also applies in the case of infringement of industrial rights by a subcontractor of the Seller. 8.2 The only exception to the previous provision is if the Seller manufactures according to the Buyer's drawings or reference samples which he does not know infringe the industrial rights of third parties. 8.3 Upon request, the Seller is obliged to provide the Buyer with information about the industrial property rights owned by the Seller or licensed to the Seller for the purpose of manufacturing the goods supplied to the Buyer. 8.4 The Buyer and the Seller shall inform each other of the possible risks of infringement of the industrial rights of third parties and cooperate in preventing such infringements.
