Common use of Information Pertinent to the Project Clause in Contracts

Information Pertinent to the Project. The CITY shall assist the CONSULTANT by placing at the CONSULTANT's disposal available information pertinent to the Project (including previous reports and any other data relative to design or construction of the Project), and the CITY shall advise the CONSULTANT as to what information, if any, the CITY believes to be accurate. The CONSULTANT is ultimately responsible for satisfying itself as to accuracy of any Data provided, and, furthermore, the CONSULTANT is responsible for bringing to the CITY's attention, for the CITY's resolution, any material inconsistencies or errors in such Data which come to the CONSULTANT's attention. If the CITY requires the CONSULTANT's assistance in resolving any error or inconsistency, such Services may be provided by mutual agreement of the parties, and shall be reimbursed by the CITY pursuant to Subsection 2.1.22, above.
