Information System Security and Protection of Confidential Information. 13.4.1. The Contractor shall comply with applicable provisions of the Health Insurance Portability and Accountability Act (HIPAA) of 1996, codified in 42 USC §1320(d) et seq. and 45 CFR parts 160, 162 and 164. 13.4.2. The Contractor shall ensure that confidential information provided through or obtained by way of this Agreement or services provided, is protected in accordance with the Data Security Requirements contained in Exhibit A. 13.4.3. The Contractor shall take appropriate action if a Subcontractor or Contractor employee wrongly releases confidential information.
