Common use of Installed Software Clause in Contracts

Installed Software. In respect of Software to be installed on Customer’s own hosting equipment: 6.1 the Customer shall use the Software only on its own equipment. If the Equipment becomes inoperable, the Customer shall be subject to payment for installing the Software on the replacement equipment, be entitled to use the Software on any other equipment purchased by the Customer to replace the Equipment; and 6.2 the Customer may only make one copy of the Software for back- up purposes only and shall not use such copy for any other purpose(s) and/or provide copies of the Software to End Users or any third party. For the avoidance of doubt, providing an alternative platform or testing do not constitute back-up purposes for the purpose of this paragraph 6.2.
